Question & AnswerQ&A (LTFRB MEMORANDUM CIRCULAR NO. 2004-043)
All owners/operators of private vehicles classified as Truck, Aluminum Van, or other configurations used for hauling purposes, except tricycles, registered with the LTO are required to secure a CPC.
Vehicles operated exclusively for the owner's own business may be exempted from securing a CPC upon filing a Petition/Application for Exemption with necessary supporting documents as determined by the LTFRB.
The documents include Certificates of Registration and Official Receipts, Certificate of Incorporation or Cooperation, Business Name registration, Business Permit or Mayor's Permit, Financial Statement for the last two fiscal years, Income Tax Return, and SSS Enrollment/Coverage of employees.
Owners/operators are given sixty (60) days from the effectivity of the circular to file the Petition/Application.
Traffic enforcement units are ordered to apprehend drivers of such vehicles starting February 15, 2005, unless they can present proof of CPC or exemption.
The goals include promoting and developing the public land transport sector and maintaining and fostering fair competition in the trucking transport industry.
No, tricycles are exempt from the CPC requirement under this circular.
All Regional Offices of the LTFRB must post the circular conspicuously and cause its publication at least once in a newspaper of general circulation in their respective regions.
The circular takes effect fifteen (15) days after filing three copies with the UP Law Center, following Presidential Memorandum Circular No. 11 dated October 9, 1992.
