Law
Nlrc En Banc No. 01-05
Decision Date
Sep 1, 2005
The NLRC establishes a new schedule of legal fees and deposits, including exemptions for indigent litigants, to ensure that charges reflect the full cost of services rendered while maintaining access to justice.

Q&A (NLRC EN BANC Resolution NO. 01-05)

The resolution adopts a new schedule of legal fees and deposits payable to the National Labor Relations Commission (NLRC) to adjust fees by just and reasonable rates sufficient to cover the full cost of services rendered, pursuant to Executive Orders.

The filing fee for a Petition for Injunction or TRO is set at P3,000.00.

The deposit fee for claims over P18,000.00 is 0.5% of the amount in excess of P18,000.00.

No, indigent litigants who meet the income and property ownership qualifications are exempted from immediate payment of fees/charges, which will instead be a lien on any judgment rendered in their favor unless otherwise provided by law.

The litigant and his/her immediate family must have a gross income not exceeding twice the monthly minimum wage and must not own real property with a fair market value exceeding P300,000 as stated in the current tax declaration.

Falsity in the affidavit is sufficient cause to dismiss the complaint or action, or to strike out the pleading, in addition to any criminal liabilities incurred.

The Injunction Expense Fund, with a minimum amount of P5,000.00, is refundable.

The filing fee for a Motion to Quash related to a Writ of Execution is P500.00.

For awards less than P5,000, the execution fee is a flat rate of P200.00.

The resolution took effect fifteen (15) days after its publication in newspapers of general circulation.
