DOLE Department Order No. 104-10 delineates the responsibilities of the National Wages and Productivity Commission, Regional Tripartite Wages and Productivity Boards, and other DOLE agencies in the transfer and implementation of Facility Evaluation and Time and Motion Studies functions to enhance labor standards and productivity.

Questions (DOLE DEPARTMENT ORDER NO. 104-10)

It is issued pursuant to Article 101 of the Labor Code of the Philippines, Department Orders No. 3 (1988) and No. 33 (1991), and Executive Order No. 366 (DOLE Rationalization Plan).

To clarify and delineate the functions and responsibilities among DOLE agencies in the conduct of Facility Evaluation (FE) and Time and Motion Studies (TMS).

The BWC must: (1) turn over records including summary reports of regional FE implementation to the NWPC; (2) provide necessary assistance in reviewing existing rules/guidelines upon NWPC request; and (3) assist in FE and TMS training for concerned DOLE agencies upon NWPC request.

They must: (1) assist in conducting FE and TMS training for concerned DOLE agencies in their regions upon RTWPBs request; (2) monitor implementation of approved FE and TMS; and (3) submit compliance reports to the DOLE Regional Director, with copy furnished to the RTWPBs.

The NWPC must: (1) conduct FE and TMS training for NWPC, RTWPBs, and DOLE ROs; (2) review existing rules/guidelines on FE and TMS and amend/revise policies/directives/laws where necessary; (3) review FE Orders and Time and Motion Standards prepared by RTWPBs prior to implementation; (4) conduct information awareness campaign; and (5) provide technical assistance to RTWPBs when necessary.

RTWPBs must conduct actual FE and TMS upon request or application of an establishment.

RTWPBs must submit to the Commission (NWPC) for review and affirmation all FE Orders and Time and Motion Standards before implementation.

They must provide technical assistance to DOLE Regional Offices in implementing existing rules, guidelines, and standards on FE and TMS.

RTWPBs must conduct an information awareness campaign.

The inspectorate arm of the DOLE.

DOLE ROs submit summary reports to RTWPBs; RTWPBs then submit the same to the NWPC and to the DOLE Secretary.

It ensures that FE Orders and TMS standards prepared by RTWPBs are reviewed and affirmed by the NWPC prior to implementation, providing centralized policy compliance and consistency.

They monitor the implementation of the approved FE and TMS and report compliance to the DOLE Regional Director (with copy furnished to the RTWPBs).

While the formulation/transfer is mentioned in the basis, the BWC’s remaining roles in this Order are to turn over records, assist in review of existing rules upon NWPC request, and assist in training upon NWPC request.

If any part or provision is declared invalid or unconstitutional, the remaining provisions not affected continue in full force and effect.

Fifteen (15) days after complete publication in two (2) newspapers of general circulation.
