R.A. No. 6758, also known as the Compensation and Position Classification Act of 1989 or the Compensation Standardization Law, mandates the standardization of compensation in the government.
Section 5, Article IX-B of the 1987 Philippine Constitution mandates the standardization of compensation in the government.
Section 81 of R.A. 7160 provides that compensation in local government units as determined by the sanggunian concerned shall conform to the provisions of R.A. 6758 (the Compensation Standardization Law).
The President of the Philippines, pursuant to Section 4, Article V of the Constitution, exercises general supervision over local government units to ensure compliance within the scope of their powers and functions.
Administrative Order No. 42 clarified the authority of the Department of Budget and Management (DBM) to issue policies and guidelines on position classification and compensation in local government units and affirmed the continued adoption of the Compensation Standardization Law in local governments.
Section 2 prohibits the grant of salary adjustments and other forms of compensation to officials and employees that are not consistent with the provisions of R.A. No. 6758 and its implementing rules and regulations.
Officials responsible for violations of the Compensation Standardization Law, including its implementing rules and regulations, may face administrative and criminal sanctions.
They are tasked with reviewing and evaluating requests for allotments, especially for personal services, to ensure conformity with existing rules, policies, and guidelines on compensation.
The Administrative Order took effect immediately upon its issuance on June 25, 1996.
