Q&A (PCG MEMORANDUM CIRCULAR NO. 04-94)

Republic Act 5173, specifically Sec. 3(g), empowers the Philippine Coast Guard to enforce laws governing manning, citizenship, protection, welfare, and related aspects of merchant seamen.

It applies to Philippine-registered tugs and dredges engaged in both international and domestic voyages.

The purpose is to amend the provisions on minimum manning requirements under Memorandum Circular No. 11-93 dated 23 Aug. 1993 for Philippine-registered tugs and dredges.

The required officers include a Master (Chief Master Mariner), Chief Mate (Chief Officer), Second Officer (Second Mate), and Third Officer (Third Mate).

A Chief Officer license is required for a Master on coastwise trade vessels over 500 gross tons.

For vessels 35 gross tons and under, the deck department requires a Master and Minor Patron or SPUO (Special Permit for Unlicensed Operator).

The engine department must have a Chief Engineer, First Assistant Engineer, Second Assistant Engineer, and Third Assistant Engineer.

A Radio Officer 1st Class license is required for international ocean-going tugs and dredges over 500 gross tons.

It takes effect upon publication in a newspaper of general circulation or 15 days after submission to the UP Law Center.
