Section 12 of Republic Act No. 5921, also known as the Act Regulating the Practice of Pharmacy, mandates the registration of detailmen or medical representatives with the Professional Regulation Commission and the Board of Pharmacy.
Medical representatives, also referred to as professional sales representatives or detailmen, are individuals who represent authorized drug establishments for the purpose of promoting the company’s products to duly licensed professionals.
Drug establishments refer to any organization or company involved in the manufacture, importation, repacking, and/or distribution of drugs or medicines as defined under DOH Administrative Order No. 56, Series of 1989.
The resolution reinforces the legal requirement on the mandatory registration of medical representatives or professional sales representatives with the Professional Regulation Commission and the Board of Pharmacy.
The applicant must have undergone a comprehensive training program conducted by a training provider duly accredited by the Board of Pharmacy.
They were allowed to apply for registration only until June 30, 2015. After this date, only those who complied with training requirements from accredited providers shall be registered.
The Standards and Inspection Division (SID) is responsible for accepting applications for accreditation of training programs and providers, as well as applications for registration as medical representatives.
Drug establishments must require all medical representatives or professional sales representatives under their employ to register with the Professional Regulation Commission and the Board of Pharmacy, according to the provisions of this resolution and the Revised Guidelines.
The Revised Guidelines on the Registration of Medical Representatives or Professional Sales Representatives are rules promulgated by the Board to govern the registration process and standards, integrated as Annex A of the Resolution.
There have been many pharmaceutical and similar entities employing medical representatives without complying with the legal registration requirements, as evidenced by the minimal number of applications for accreditation and registration received in recent years.
