Act No. 2354 introduces changes to the office of lieutenant-governor in several subprovinces in the Philippines, making it an elective position and outlining the election process, qualifications, and removal procedures, as well as allocating funds for public improvements and establishing a suboffice of the provincial treasurer in Abra.

Questions (Act No. 2354)

To make the office of lieutenant-governor elective in the specified subprovinces: Marinduque (Tayabas), Catanduanes (Albay), Abra (Ilocos Sur), Siquijor (Oriental Negros), Masbate (Sorsogon), and Romblon (Capiz), and to provide for elections and related matters.

From and after the date on which the Act takes effect.

The provincial board in each province organized under Act No. 83 where a subprovince mentioned exists must call a convention within sixty (60) days after the passage of the Act.

All municipal presidents, vice-presidents, and councilors of the subprovince.

Secret ballot.

Plurality of the votes.

It acts as the board of canvassers.

The provincial board must communicate the result immediately to the Governor-General for confirmation; the lieutenant-governor assumes charge after taking the proper oath once confirmation is secured.

A new election shall be held in the same manner until such confirmation is secured.

He performs duties until the next general election at which his successor is duly elected and qualified.

The candidate must have all qualifications required by the Election Law for candidates for provincial offices.

They must resign from office at least forty-five (45) days before the date of the special election held sixty (60) days after the passage of the Act.

They may be suspended or removed under the same circumstances, effect, and manner, and for the same reasons as specified in Section 19 of Act No. 83, as amended; and provisions on suspension/removal of elective provincial officers and confirmation of elections are applicable.

Act No. 1582, as amended, applies to the lieutenant-governors of the subprovinces mentioned in Section 1, insofar as possible.

It adds that 70% of all taxes or fines collected by the subprovince of Abra (or those hereafter established) go to public improvements, public works repair/erection of public buildings in Abra; and 30% goes to the general funds of the province.

Seventy percent (70%) of Abra’s proportional share (based on population participating per last official census) of internal-revenue taxes belonging to the Province of Ilocos Sur is set aside for the exclusive benefit and use of Abra’s inhabitants.

Funds are expended upon resolutions of the provincial board of Ilocos Sur; the provincial treasurer (or deputy) disburses only upon order of the lieutenant-governor of Abra, accompanied by a certified copy of the provincial board resolution authorizing the expenditure.

To establish a permanent suboffice of the provincial treasurer of Ilocos Sur at Bangued, Abra subprovince, and provide suitable quarters for it.

It takes effect on its passage, in accordance with Section 1 of Act No. 1945.
