The Implementing Rules and Regulations (IRR) of the Philippine Nursing Act of 2002 aims to effectively implement the provisions of the law, covering policy statements, definitions, board composition, licensure examinations, nursing education, nursing practice, health human resource development, and penalties for violations.

The IRR is issued pursuant to Section 38, Article X of RA No. 9173.

Nursing education, nursing service, and community health nursing.

It is composed of one (1) Chairperson and six (6) members, representing the three areas of nursing, and is under the administrative supervision and control of the PRC.

Nominees must be duly licensed/registered nurses chosen only from among the nominees submitted by the accredited professional organization of nurses.

The PRC notifies the APO at least in the last year of a term; the APO submits at least three nominees per vacancy not later than three months before the vacancy occurs; the PRC ranks them and submits two nominees per vacancy not later than two months before; the appointment is to be issued not later than 30 days before the scheduled licensure examinations.

They must be natural-born citizens and residents; members of good standing of the accredited professional organization; registered nurses with a master’s degree in nursing, education, or allied medical profession (majority must have a master’s degree in nursing); at least 10 years continuous practice with the last 5 years in the Philippines; and must not have been convicted of an offense involving moral turpitude.

The President may remove or suspend a member after being given the opportunity to defend in a proper administrative investigation by the PRC on grounds of continued neglect of duty/incompetence, commission/toleration of irregularities in licensure exams, or unprofessional/immoral/dishonorable conduct.

They must immediately resign from teaching positions and review programs for nursing board exams; resign from private employment/government employment including GOCCs; and must not have pecuniary interest or administrative supervision over institutions offering BS Nursing, including family pecuniary conflicts.

A general average of at least 75%, with no subject below 60%.

The examinee must retake the examination but only in the subject(s) where the rating was below 60%, and must obtain at least 75% in the repeated subject(s).

Through registration by reciprocity without examination; through a special/temporary permit for a specific project/mission/employment; and their authorization is subject to relevant statutory requirements referenced in the IRR.

Grounds include: causes mentioned in Section 22 of RA 9173; unprofessional/unethical conduct; gross incompetence or serious ignorance; malpractice or negligence; fraud/deceit/false statements in obtaining the license/permit; violation of RA 9173 and its IRR, Code of Ethics, Code of Technical Standards, Board/Commission policies, or permit conditions; and practicing during suspension.

Not to exceed four (4) years.

A person practicing nursing is one who initiates and performs nursing services for individuals, families, and communities in any health care setting, whether singly or collaboratively; it includes nursing care across the life cycle (conception, labor, delivery, infancy, childhood, adulthood, old age) and nursing roles in health team settings.

Yes, providing nursing care includes administration of written prescription for treatment/therapies and oral/topical/parenteral medications, and includes specific labor-related internal examination in the absence of antenatal bleeding; special training is required for suturing perineal laceration according to protocol.

The nurse must observe the Code of Ethics and Code of Technical Standards, uphold standards for safe nursing practice, and maintain competence by continual learning through continuing professional education (subject to Board approval).

Penalties apply to unlawful nursing practice without required registration/permit or exemption, using another’s license, using invalid/suspended/revoked/expired permits, giving false evidence to obtain registration, falsely posing/advertising as a licensed nurse, appending “BSN.R.N.” or similar without qualification, abetting illegal practice, and also violations related to conducting review/restricted educational programs without permit/clearance; and violations of minimum base pay and mandated incentives/benefits for nurses.

A fine of not less than P50,000 nor more than P100,000, or imprisonment of not less than one (1) year nor more than six (6) years, or both, at the court’s discretion.

After fifteen (15) days following complete or full publication in the Official Gazette or in any two (2) newspapers of national circulation, whichever comes first.
