It is issued pursuant to Section 9 of Republic Act No. 9175 (Chainsaw Act of 2002) to implement the Chainsaw Act for the Province of Palawan.
The State policy is to conserve, develop, and protect forest resources through sustainable forest management and to eliminate illegal logging/forest destruction facilitated by chainsaws.
It refers to any portable power saw or similar cutting implement made operative by an electric or internal combustion engine that can be used for felling trees or cutting timber (among others).
A chainsaw dealer is a person engaged in manufacture, importation, distribution, purchase and/or sale of chainsaws, as authorized by the PCSD.
All chainsaw owners/possessors must apply for PCSD registration within three months from the effectivity of the Order.
Registration with DENR prior to the effectivity of the Order is considered terminated; registration must henceforth be applied with PCSD.
Generally valid for two (2) years, renewable for the same period. For non-commercial orchard/fruit tree farmers and similar entities whose work is not related to wood/timber production/processing/trade, validity is five (5) years, renewable for the same period unless revoked.
Coding sequence: (1) Municipal Code where registered, (2) last two digits of the year of registration, (3) control number of the chainsaw.
The Certificate of Registration number, date of registration, and expiry date are indicated in a serialized sticker attached to the chainsaw.
Imprisonment of four (4) years, two (2) months and one (1) day to six (6) years, and/or a fine of not less than PHP 15,000, with confiscation of the chainsaw in favor of the government.
Imprisonment of not less than one (1) month nor more than six (6) months and a fine of not less than PHP 1,000 nor more than PHP 4,000.
Imprisonment of six (6) years and one (1) day to eight (8) years or a fine of not less than PHP 30,000 but not more than PHP 50,000, and confiscation of the unlawfully used chainsaw.
The user shall be arrested even without a warrant when the chainsaw is used to cut trees/timber without a valid Certificate of Registration and authorization. The apprehending party must deliver the offender and the confiscated chainsaw within thirty-six (36) hours and file the proper complaint/information.
The PCSDS has power to administratively confiscate chainsaw/s not registered under the Order or those used in illegal cutting of timber or forest products.
The owner/user must report to the nearest DMO within three (3) calendar days from the date of loss. The DMO issues a recall of the Certificate of Registration, informs the SCU, and the SCU then informs the Chairman of the PCSD through the Executive Director.
The owner must immediately report to the DMO and request revocation; if the Certificate has expired, the owner must notify the DMO in writing that renewal is no longer intended.
