The purpose of RA No. 9367 is to mandate the use of biofuels to reduce dependence on imported fuels while protecting public health, the environment, and natural ecosystems, consistent with sustainable economic growth and livelihood opportunities.
The Department of Energy (DOE) is responsible for formulating rules and regulations to guide operations of government and private entities involved in energy resource supply and distribution.
This Department Circular implements the Philippine National Standard Specification for Biodiesel and Biofuel Blends pursuant to RA No. 9367.
Biodiesel must conform to the Philippine National Standard PNS/DOE QS 002:2007 for Coconut Methyl Ester (B100).
FAME-blended diesel oils must conform to PNS/DOE QS 004:2007 under the National Biofuels Program.
Operators of retail outlets or oil companies must require quality certification from product suppliers for every delivery before blending with base diesel.
They must adhere to good housekeeping protocols in handling, storage, and dispensing of biofuel blends and ensure proper training and equipment.
Only entities determined qualified by the DOE, which submit certification of blending capability and comply with RA No. 8479, may import unblended or base diesel.
They must submit to the DOE a certification of their capability and capacity to blend the imported base diesel with the required biofuel component and comply with notice and reportorial requirements under RA No. 8479.
Persons committing prohibited acts are subject to criminal and/or administrative actions in accordance with existing or future DOE rules and regulations.
