Q&A (PHIC PHILHEALTH CIRCULAR NO. 05, S. 2009)

Section 18-20 of the Implementing Rules and Regulations of RA 7875, as amended, mandates employers to enroll their employees, deduct premium contributions, and remit them along with the employer's share to PhilHealth.

Employers who fail to remit the required premium contributions are liable for violation of RA 7875 as amended.

NHIP members engaged in multiple employments, both in Government and Private Sectors, who have aggregate monthly contributions exceeding the maximum prescribed premium rate.

They may avail either a one-time adjustment of overpayment or a refund of the overpayment in the personal share, subject to specific conditions.

The member must be separated from all employments, the overpayment must exceed the maximum rate, the overpayment resulted from multiple employment, it occurred after the circular's effectivity, the period must be posted in PMAIS and Treasury Database, and overpayment should be reflected as advanced payment in IPP.

The overpayment must be due to multiple employment, incurred after the guideline's effectivity, posted in PMAIS and Treasury database, member is 60 years old or above with at least 120 paid monthly contributions, and the member is no longer employed.

A properly filled out request form or letter, two valid photo IDs, employment contracts or certificates reflecting income and employment status, and other documents as required by PhilHealth Collection Sections.

It took effect fifteen (15) days after its publication and covers premium contributions from January 2009 onwards.

The PMAIS must have the period covered for adjustment or refund posted to validate the overpayment claims.

The maximum premium rate is prescribed in the NHIP premium contribution schedule referenced in the circular.
