Executive Order No. 76 implements a modified salary schedule for civilian and military personnel in the Philippine government, with implementation in yearly tranches and specific coverage and exclusion criteria.

Q&A (EXECUTIVE ORDER NO. 76)

The fourth tranche covers civilian personnel in the Executive, Legislative, and Judicial Branches, Constitutional Commissions/Offices, State Universities and Colleges, GOCCs, GFIs, and LGUs regardless of employment status, as well as military and uniformed personnel under the DND, DILG, PCG, and NAMRIA.

Individuals engaged through job orders, contracts of services, or similar arrangements, and civilian personnel in government entities that are exempted from R.A. No. 6758 and implementing their own compensation systems approved by the Office of the President.

Effective June 1, 2012, except for the President, Vice President, and Cabinet Secretaries for whom it is effective July 1, 2012.

LGU sanggunian determines implementation based on income class and financial capability, with salary rates not exceeding specified percentages of national government rates and subject to personal services cost limitations under Sections 325(a) and 331(b) of R.A. No. 7160.

Amounts are charged against the Miscellaneous Personnel Benefits Fund (MPBF) in the FY 2012 GAA and from available savings, with subsequent inclusion in annual GAAs.

In accordance with the Constitution, no increase in their compensation shall take effect until after the expiration of the full term of the relevant members approving the increase.

The remaining provisions not affected shall remain valid and subsisting, as stated in the separability clause.

GOCCs and GFIs shall implement lower salary rates at uniform percentages compared to Annex A salaries, while LGUs shall do similarly according to their income class schedules.

The Department of Budget and Management (DBM) is tasked to prepare and issue the necessary rules and regulations to implement the EO.
