Q&A (EXECUTIVE ORDER NO. 98)

EO No. 98 provides guidelines on the detail of personnel of the Armed Forces of the Philippines (AFP) and the Philippine National Police (PNP) to civilian offices and officials, rationalizing and updating the rules governing their deployment to maximize utilization and ensure better performance of their mandates.

Except for the detail of military personnel to the President, the detail of military personnel to civilian offices and officials requires evaluation and recommendation by the Chief of Staff of the AFP and approval of the Secretary of the Department of National Defense (DND).

An Aide-de-Camp is a commissioned officer of the AFP in active service, selected to provide general assistance to entitled government officials and foreign military or civilian dignitaries.

A Military Assistant is a commissioned officer of the AFP with a field grade rank detailed to a civilian office or official to render professional or technical advice and assistance on military matters.

The President, the Vice President, visiting foreign military or civilian dignitaries, the Secretary of the Department of National Defense, and other government officials as approved by the DND Secretary are entitled to Aide-de-Camps.

Military personnel may not be detailed or assigned to private individuals unless approved by the President upon recommendation of the DND Secretary.

A former President can have up to twelve (12) military assistants, military administrative assistants, and/or protective security personnel in any combination. The spouse, widow, or identified next of kin can have up to six (6) military administrative assistants and/or protective security personnel.

The Director General of the Philippine National Police (PNP) approves the detail of PNP personnel as Protective Security to government officials and authorized private individuals.

The initial detail is for one (1) year and may be extended up to a maximum of three (3) years for exceptional and highly justifiable reasons.

No, EO No. 98 does not apply to military personnel detailed to Philippine diplomatic missions abroad or those under the Presidential Security Group.

The separation from office of the entitled government official automatically terminates the detail of the concerned military personnel.

The PSPG, an operational unit under the PNP, is mandated to provide security for government officials, foreign dignitaries, and private individuals authorized to be given protection.

EO No. 98 took effect immediately upon its promulgation on November 29, 2019.
