The Professional Regulatory Board for Professional Teachers issues guidelines for the issuance of special permits to para-teachers based on the shortage or absence of professional teachers in certain areas, with special provisions for the Autonomous Region of Muslim Mindanao.

It amends Section 26, Article III of R.A. No. 7836 by providing that those who failed the licensure examination for professional teachers with a rating not lower than five percentage points from the passing general average may be eligible as para-teachers upon issuance by the Board of a two-year special permit, renewable for a non-extendible period of two years.

Para-teachers must be assigned to areas where there is shortage or absence of a professional teacher, as identified and provided by the Department of Education and the ARMM education department to the Board for Professional Teachers and to the Commission.

It mandates all public and private elementary and secondary schools not to employ teachers who are not registered with the PRC, recognizing PRC registration (Certificate of Registration) as an indispensable requirement to practice the teaching profession under R.A. No. 7836.

Because of the MOA where DepEd signified it will not issue certifications identifying shortage areas, the Board resolves it will only accept applications for special/temporary permits when DepEd provides a list identifying areas of shortage/absence (for areas within DepEd jurisdiction).

BPT/PRC shall not accept applications unless DepEd provides a list indicating shortage or absence of professional teachers in the areas within its jurisdiction.

It allows issuance for ARMM based on a list provided by ARMM identifying areas of shortage or absence of professional teachers, officially communicated to the Board and Commission through a Memorandum Circular, which becomes the basis for accepting applications and issuing permits upon Board approval via a Board Resolution.

P200.00 per year upon application, or P400.00 for the two-year validity period.

P400.00 upon renewal, counted from the expiration date of the initial special permit.

They remain valid within the period specified, and may be renewed for a non-extendible period of two (2) years.

The renewal and validity date shall be counted from the date appearing on the Board Resolution approving the application for issuance of the special/temporary permit, disregarding the date of payment of fees.

Permits with a validity of five (5) years shall be valid within the period specified, but they may no longer be renewed pursuant to R.A. No. 9293.

It implements the statutory requirement that the special permit shall indicate the area of assignment of the para-teacher (an area of shortage or absence), consistent with R.A. No. 9293's amendment to R.A. No. 7836.

It takes effect after fifteen (15) days following its full and complete publication in the Official Gazette or any newspaper of general circulation in the Philippines.

It orders the Resolution to be circularized and disseminated widely through the Department of Education and the Autonomous Region of Muslim Mindanao.

Even when the shortage/absence list is provided (especially for ARMM), issuance of the permits requires Board approval through a Board Resolution, ensuring the permits are issued only after formal approval.
