It is issued pursuant to Joint Administrative Order (JAO) No. 2014-01, which covers the no registration, no travel policy for four-wheeled motor vehicles.
They must at all times wear their official uniform and official ID.
The vehicle must not bear LTO-issued license plates and/or the corresponding third plate sticker on the windshield.
The current Official Receipt (OR), Certificate of Registration (CR) or photocopy thereof, and the driver’s license.
They are charged with Failure to Attach Authorized Motor Vehicle License Plates under Section II(e) of JAO No. 2014-01, with a fine of PHP 5,000.00.
The guidelines state it shall not apply if an application for Special Plates was made, provided the owner can present the LTO official receipt for the payment of such application.
Sales Invoice dated within seven (7) days prior to apprehension; Certificate of Cover (COC) of Third Party Liability (TPL) insurance dated on or after the issuance of the Sales Invoice; and Certificate of Stock Reported (CSR) dated on or prior to the issuance of the Sales Invoice.
The driver/owner and motor vehicle are penalized under JAO 2014-01: the owner is fined PHP 10,000.00 under Section II(a) for driving an unregistered motor vehicle; the driver is fined PHP 1,000.00 under Section I(j).
The driver may be cited with reckless driving under Section I(e).
The fine of PHP 2,000.00 is not collected or imposed if it is the first offense; however, the record remains and the future offense will be treated as a second offense.
The enforcer charges the driver with reckless driving, but the same is to be reversed during adjudication to prevent collection of the reckless driving penalty, while remaining in the driver’s record.
If the operation of the unregistered vehicle exceeds thirty-seven (37) days, i.e., seven (7) days for registration plus one (1) month under Section II(a) of JAO 2014-01, the vehicle is impounded and released only upon valid registration and payment of appropriate fines and penalties.
They must submit the DAR within twenty-four (24) hours (office hours) immediately after any law enforcement activity, and it must be duly received by the encoding section of either the DO or Operations Division.
Apprehensions submitted in the morning (8:00am–12:00nn) are encoded in the afternoon (1:00pm–5:00pm); those submitted in the afternoon (5:00pm onwards) are encoded in the morning (8:00am–12:00nn) of the following day.
All TOPs must be transmitted within twenty-four (24) hours from the date of apprehension to the District Offices or Regional Office with geographical area of responsibility (GAOR).
The TOP must include: all required data on the driver/operator and motor vehicle (including date, time, and place of apprehension); the provision of law violated and/or the specific act/omission in addition to the no registration, no travel policy violation; and all other data necessary for effective and immediate adjudication.
No erasures/alterations/cancellation are allowed. A TOP claimed lost must be accompanied by an Affidavit of Loss and a Police and/or Barangay blotter; without prejudice to accountability.
The apprehension may be nullified, and the erring personnel may face appropriate disciplinary action and/or revocation of the deputation order, without prejudice to filing appropriate criminal complaints.
