The LTFRB Memorandum Circular No. 008-15 provides guidelines for the issuance of Special Permits in the Philippines, covering all modes of transport services except Truck-for-Hire Service, with specific requirements and restrictions for Special Permits during Special Occasions or Activities and Special Holidays.

Questions (LTFRB Memorandum Circular No. 2015- 008)

To clarify, review, and amend the LTFRB policy on the issuance of Special Permits to ensure consistent interpretation and application for various transport services sought for special trips.

Truck-for-Hire Service.

The purpose of the trip (e.g., excursions, seminars, family trips/festivities) and the origin and destination points.

It must be valid during the period covered by the Special Permit (or an extension of validity has been duly filed) and must not be suspended at the time of filing and during the period covered.

At the LTFRB Central Office.

A maximum of three (3) days.

(1) If approval would result in the abandonment of route; or (2) insufficiency of public utility vehicles (PUVs) in the authorized route of the applicant.

At least a day before the intended trip.

Duly accomplished Request Form; Franchise Verification; copy of valid government-issued ID with photograph; copy of CR/OR of authorized unit(s) (currently registered); copy of Passenger Accident Insurance Coverage; and copy of notarized Contract/MOA/Affidavit of Operator stating purpose of special permit.

Board Resolution authorizing the application for special permit, and Board Resolution/authorization for the representative to file petition, follow-up, receive order, and sign papers for the realization of the matters.

The authorized unit(s) must be provided with a signboard bearing the description 'SPECIAL PERMIT' in bold letters with a size of at least six (6) inches in height and three (3) inches in width.

The original copies of the Special Permit and payment receipt must always be carried by the driver; and the driver is prohibited from picking up or dropping off paying passengers along the way.

Public Utility Bus (PUB) Service only.

At least two (2) weeks prior to the start of the duration of the Special Permit.

The PUB units should not be more than ten (10) years old, and the fare must be the authorized fare on the applied route.

Holy Week (Palm Sunday to day after Easter Sunday); All Saints Day (Oct 30 to Nov 3); Eidul Fitr and Eidul Adha (2 days before to a day after the feasts); Christmas Season (Dec 23 to Jan 3); National Elections (2 days before to 2 days after elections, subject to COMELEC guidelines).

The application should indicate the specific address of the terminals at both ends of the applied route.

No Special Permit is needed if PUVs are used during emergency cases (e.g., passenger-patient needs immediate medical assistance) or during calamities (evacuating people or transporting goods to/from areas of calamity).

Violations are penalized in accordance with Item IV, No. 1 (Modes of Colorum Operation) of Joint Administrative Order No. 2014-001 and other existing issuances.
