Questions (Republic Act No. 2075)

Republic Act No. 8173 is entitled an “Act granting all citizens’ arms equal opportunity to be accredited by the Commission on Elections,” and it was approved on December 20, 1995.

RA 8173 amended Section 27 of Republic Act No. 7166, as amended by Republic Act No. 8045.

It amended Section 27, titled “Number of Copies of Election Returns and Their Distribution.”

Seven (7) copies.

The first copy is delivered to the city or municipal board of canvassers.

The second copy is directed to the Congress, specifically to the President of the Senate.

The third copy is sent to the Commission (COMELEC), while the fourth copy goes to the dominant majority party as determined by the Commission in accordance with law.

The fifth copy is delivered to the dominant minority party as determined by the Commission in accordance with law.

The sixth copy is delivered to a citizens’ arm authorized by the Commission to conduct an unofficial count.

Accreditation is subject to Section 52(k) of Batas Pambansa Blg. 881 (Omnibus Election Code).

The seventh copy is deposited inside the compartment of the ballot box for valid ballots.

Seven (7) copies. The structure is similar: first to city/municipal board of canvassers, third to provincial board of canvassers, sixth to an authorized citizens’ arm for unofficial count, and seventh inside the ballot box compartment for valid ballots.

It is delivered to the provincial board of canvassers.

The sixth copy is for a citizens’ arm authorized by the Commission to conduct an unofficial count, with accreditation subject to Section 52(k) of Batas Pambansa Blg. 881.

It repeals all laws, decrees, executive orders, rules and regulations, or parts thereof, inconsistent with RA 8173.

It takes effect immediately upon its approval.

To grant all citizens’ arms equal opportunity to be accredited by the Commission on Elections, reflected in the allocation of a copy of election returns to an authorized citizens’ arm for an unofficial count.
