Law
Executive Order No. 106
Decision Date
Dec 4, 2012
Benigno S. Aquino III expands the Benoni Port Zone to enhance regional trade and accommodate increasing vessel and passenger traffic, placing it under the jurisdiction of the Philippine Ports Authority for effective development and utilization.

Q&A (EXECUTIVE ORDER NO. 106)

It further expands and delineates the territorial jurisdiction of the Benoni Port Zone in Barangay Benoni, Municipality of Mahinog, Province of Camiguin.

The Philippine Ports Authority (PPA) has administrative jurisdiction over the Benoni Port Zone.

The expansion was due to the strategic location of the Port of Benoni, which links Mindanao to the rest of the country, and the significant growth in vessel and passenger traffic necessitating accommodation of projected increases and development of adequate facilities.

The expanded area is TWO HUNDRED NINETY-EIGHT THOUSAND EIGHT HUNDRED TWENTY-EIGHT SQUARE METERS AND ONE HUNDRED FORTY-TWO SQUARE DECIMETERS (298,828.142 sq.m.), more or less.

The PPA shall implement a program for proper zoning, planning, development, and utilization of the port consistent with the government's regional industrial plans.

All inconsistent issuances, orders, rules, and regulations or parts thereof are repealed, amended, or modified accordingly by EO No. 106.

It took effect immediately upon publication in a newspaper of general circulation.

Yes, there is a separability clause which states that if any provision is declared invalid or unconstitutional, other unaffected provisions shall remain valid and subsisting.

They precisely define the expanded boundaries of the Benoni Port Zone to legally delimit its territorial jurisdiction.
