Q&A (EXECUTIVE ORDER NO. 311)

The President is authorized under Republic Act No. 8041, also known as the National Water Crisis Act of 1995.

The private sector involvement may include franchising, concession, management, privatization, and contracts implemented under Build-Operate-Transfer (BOT) and related schemes for financing, constructing, repairing, rehabilitating, improving, and operating water facilities and projects.

The reorganization aimed to streamline and correct dysfunctions in MWSS’s structure and operation, making it more effective, efficient, and responsive to potable water needs and preparing for eventual privatization where feasible.

The implementation may be pursuant to R.A. 8041, Proclamation No. 50 as amended, Republic Act No. 6957 as amended by Republic Act No. 7718, and other applicable laws, rules, orders, and proclamations.

All executive issuances, orders, rules, and regulations inconsistent with EO No. 311 are revoked, amended, or modified accordingly.

The President may enter into negotiated contracts for projects under Build-Operate-Transfer and related schemes for a period of one year after the effectivity of R.A. 8041, or until July 15, 1996.

The private sector is recognized as the main engine for growth and development, and encouraged to engage in the financing, construction, operation, and maintenance of infrastructure projects including water supply and sewerage.

The inclusion of MWSS in the list of government-owned or controlled corporations for retention under Executive Order No. 37 is revoked, facilitating its privatization or private sector involvement.
