RA 11781 is titled the “Don Honorio Ventura State University-Sto. Tomas, Porac, Lubao, Candaba, Apalit, Mexico, Sta. Rita, Floridablanca, Guagua, and Sasmuan Campuses Act.” Its purpose is to convert DHVSU extension campuses located in specified municipalities of Pampanga into regular DHVSU campuses and to appropriate/enable funding for their operation.
The covered municipalities are: Sto. Tomas, Porac, Lubao, Candaba, Apalit, Mexico, Sta. Rita, Floridablanca, Guagua, and Sasmuan.
They are converted into regular campuses of Don Honorio Ventura State University, each to be known as a specific DHVSU campus (e.g., DHVSU-Sto. Tomas Campus, DHVSU-Porac Campus, etc.).
They must primarily provide short-term technical-vocational, undergraduate, and graduate courses within their areas of competency and specialization. They must also undertake research and extension services and provide progressive leadership in these areas.
It states that the courses must be offered pursuant to DHVSU’s mandate and according to the campuses’ capabilities, and it explicitly allows the Board of Regents to determine what is necessary to meet human resource development needs of Pampanga and Region III.
Governance is vested exclusively in the Board of Regents of DHVSU.
The DHVSU President exercises overall supervision and management. Each campus is headed by a Campus Administrator who renders full-time service and is appointed or designated by the Board upon recommendation of the search committee and the President, subject to Board guidelines, qualifications, and standards.
Positions, rights, and security of tenure of faculty members and personnel employed under existing laws prior to the conversion are to be respected.
All assets (real and personal), personnel, and records of the DHVSU extension campuses are transferred to DHVSU, along with liabilities or obligations.
All parcels of land belonging to the government occupied by the specified DHVSU campuses are transferred to DHVSU and “shall be titled under its name,” subject to a reversion clause if the campuses cease to exist/are abolished or the land is no longer needed.
The land shall revert to the concerned local government units or to the Republic of the Philippines, depending on the case, if the campuses or DHVSU campuses cease to exist/are abolished or if the land is no longer needed by DHVSU.
The amount necessary shall be included in the Annual General Appropriations Act (GAA). Meanwhile, the municipalities covered must provide the same financial support to the respective campuses until funds are included in the annual GAA.
Section 8 incorporates: (1) RA 8292 (Higher Education Modernization Act of 1997); (2) RA 9832 (DHVSU-related conversion of Don Honorio Ventura College of Arts and Trades in Bacolor into a state university—DHVTSU), as amended by (3) RA 11169 (renaming DHVTSU to DHVSU and expanding curricular offerings). These, together, serve as the governing charter of DHVSU.
If any part/provision is declared invalid, the remaining provisions not affected remain in full force and effect.
It repeals or modifies any other laws, presidential decrees, executive orders, rules and regulations that are contrary to or inconsistent with RA 11781.
It takes effect fifteen (15) days after its publication in the Official Gazette or in a newspaper of general circulation.
It references Article VI, Section 27(1) of the Constitution. It implies that the bill lapsed into law without the President’s signature when the constitutional timeframe passed.
