It is anchored on Section 1, Article XI of the 1987 Constitution, which provides that public office is a public trust and that public officers and employees must at all times be accountable to the people.
It cites the President’s power of control over all executive departments, bureaus, and offices under Article VII, Section 17 of the 1987 Constitution.
Within sixty (60) days from the issuance of the Memorandum Order.
DSOM includes: (1) Defense Strategic Planning System (DSPS); (2) Defense Capability Assessment and Planning System (DCAPS); (3) Defense Acquisition System (DAS); and (4) Defense Resource Management System (DRMS), which incorporates PPBES and FMS.
PPBES stands for Planning, Programming, Budgeting and Execution System; FMS stands for Financial Management System.
It directs focus on improving logistics capacity to address urgent requirements for combat operations.
It must optimize the use of the Modernization Trust Fund through a centralized defense acquisition system under DND, and it must be fully compliant with the Government Procurement Act, Republic Act No. 9184.
To optimize the defense budget and improve financial and management controls by pushing resources down to operating units down to company commanders and minimizing centrally managed funds in AFP General Headquarters.
The Secretary of National Defense and the Secretary of Budget and Management must jointly conduct a comprehensive review and assessment of current policies and processes on stewardship of public funds, and submit joint report and recommendations to the Office of the President.
Within sixty (60) days from the issuance of the Memorandum Order.
To incorporate the findings into appropriate reform programs and ensure their full and immediate implementation.
To investigate and inquire on the irregularities and corrupt practices of MGEN Carlos Garcia and others, and then coordinate with the DOJ to determine whether criminal and/or administrative cases may be filed.
Within ninety (90) days from issuance.
It must state the reasons for why no appropriate criminal and/or administrative cases were filed, based on their coordination.
All departments, bureaus, agencies, and instrumentalities (including GOCCs) must provide support to the Secretary of National Defense and the Secretary of Budget and Management in discharging their functions under the Memorandum Order.
Within ninety (90) days, the Secretaries must jointly submit an initial progress report to the Office of the President on implementation (Sections 1 and 2). After that, they must jointly submit quarterly reports.
If any provision is declared unconstitutional, it shall not affect the validity and effectivity of the other provisions.
It revokes, amends, or modifies any executive issuances, rules, or regulations (or parts thereof) that are inconsistent with the Memorandum Order.
It takes effect immediately.
It mandates (1) review and strengthening of defense planning, budgeting, acquisition, financial management, logistics, and budget controls; (2) review and reform of policies on stewardship of public funds with recommendations to the President; and (3) re-convening of a defense special investigating committee and DOJ coordination for potential criminal and administrative actions.
