The Partido Development Administration (PDA) was originally created under Republic Act No. 7820, also known as the Partido Development Administration Act of 1994.
The PDA was abolished because: (a) it performed functions duplicative of other government agencies; (b) it failed to achieve its intended developmental objectives and was not cost-efficient; (c) the 4th district of Camarines Sur it served still had the highest poverty incidence, and (d) it consistently operated at a loss requiring government subsidy.
The Governance Commission for Government-Owned or -Controlled Corporations (GCG) recommended the abolition pursuant to Section 5(a) of Republic Act No. 10149 or the GOCC Governance Act of 2011.
The planning and developmental functions of the PDA are to be relinquished to the appropriate local government units, while the administration and operations of the Nato Port shall be turned over to the Philippine Ports Authority.
The PDA Board of Directors shall act as the administrator and liquidator responsible for preserving assets, settling liabilities, terminating personnel, and completing liquidation activities.
The Notice of Termination must be issued within sixty (60) days from the issuance of the Memorandum Order.
Affected officials and personnel may avail separation pay calculated based on their years of service and Basic Monthly Pay (BMP): 1x BMP per year for the first 20 years, 1.25x BMP per year for years 20+1 day to 30, and 1.5x BMP per year if service exceeds 30 years.
Funding for these benefits shall come from the PDA's corporate funds, with the Department of Budget and Management ensuring sufficient funds.
The PMO is responsible for disposing of PDA assets to settle outstanding liabilities following applicable laws, rules, and regulations.
The separability clause provides that if any provision is declared invalid or unconstitutional, the other provisions not affected shall remain valid and effective.
It took effect immediately upon its publication in the Official Gazette or in a newspaper of general circulation.
