The main purpose is to devolve to municipal and city governments the authority to register fishing vessels with three (3) gross tonnage and below, which was formerly handled by the Philippine Coast Guard under MARINA's authority.
Section 139 (3) of the Local Government Code of 1991 provides that the Sangguniang Bayan shall issue licenses for the operation of fishing vessels three (3) gross tonnage or less.
The Maritime Industry Authority (MARINA) and the Philippine Coast Guard (PCG), under the Department of Transportation and Communications (DOTC), are mandated to assist and support local government units.
The transition period shall not exceed one (1) year from the effectivity of the Executive Order.
MARINA is mandated under Section 12 (f) of Executive Order No. 125, as amended by Executive Order No. 125-A, to register vessels.
LGUs should consult the Municipal/City Fisheries and Aquatic Resource Management Council (FARMC) when enacting such ordinances.
They must maintain up-to-date records of fishing vessels three (3) gross tonnage and below under their jurisdiction and regularly submit the list of registered vessels to the MARINA Regional Office, PCG Station/Detachment, and DA-BFAR.
The Department of Justice, Department of the Interior and Local Government, Department of Transportation and Communications, Department of Agriculture-Bureau of Fisheries and Aquatic Resources, Maritime Industry Authority, Philippine Coast Guard, PNP Maritime Group, National Anti-Poverty Commission-Fisherfolk Sector, League of the Municipalities of the Philippines, and League of Cities of the Philippines.
Section 5, the Repealing Clause, states that all Executive Orders, Department Orders, Memorandum Circulars, Rules and Regulations or parts thereof contrary to or inconsistent with this Executive Order and its implementing guidelines are repealed or modified accordingly.
It takes effect fifteen days after its publication in the Official Gazette or in two newspapers of general circulation and upon its filing with the Office of the National Administrative Register.
