President Ferdinand R. Marcos, Jr. signs Proclamation No. 42, declaring the regular holidays and special (non-working) days for the year 2023 in the Philippines, including important dates such as New Year's Day, Labor Day, and Christmas Day.

Questions (PROCLAMATION NO. 42)

Republic Act (RA) No. 9492 amending Section 26, Chapter 7, Book I of Executive Order (EO) No. 292 (Administrative Code of 1987). Proclamation No. 42 (s. 2022) declares the specific holidays/non-working days for 2023 pursuant to these powers.

Both are days declared by law/proclamation when work is not required for ordinary purposes, but they differ in the underlying statutory characterization and, consequently, in how workplace attendance and pay rules may be applied under labor laws and implementing guidelines (DL E / DOLE rules).

RA No. 9177 (2002) declared the first day of Shawwal as a regular holiday for Eidul Fitr. The proclamation provides that proclamations declaring Eidul Fitr and Eidul Adha will be issued after the approximate dates are determined based on the Islamic calendar (Hijra) or lunar calendar/astronomical calculations.

RA No. 9849 (2009) provides that the tenth day of Zhul Hijja be declared as a national holiday for Eidul Adha. The National Commission on Muslim Filipinos is to recommend the actual dates to the Office of the President.

It declares 2 November 2023 (Thursday) as an additional special (non-working) day nationwide.

Labor Day—1 May 2023 (Monday); Independence Day—12 June 2023 (Monday); Ninoy Aquino Day is also on Monday but it is a special (non-working) day, not a regular holiday.

Because workplace attendance, compensable time, and related labor obligations depend on how holidays are treated under labor law; implementing guidelines clarify how employers and employees should apply holiday rules to prevent disputes and ensure uniform compliance.

It takes effect immediately upon issuance. It must also be published in a newspaper of general circulation.
