Article III, Section 16 of the 1987 Constitution guarantees the right of all persons to a speedy disposition of their cases before all judicial, quasi-judicial or administrative bodies.

Republic Act No. 9285 is the Alternative Dispute Resolution Act of 2004, which promotes the use of alternative methods to resolve disputes outside traditional court litigation.

RA 9285 establishes the policy of the State to encourage and actively promote the use of Alternative Dispute Resolution mechanisms.

The Office for Alternative Dispute Resolution (OADR) was created under RA 9285 as an attached agency of the Department of Justice.

The OADR is mandated to promote, develop, and expand the use of Alternative Dispute Resolution in both the private and public sectors.

The President of the Philippines has the authority to declare National ADR Day by virtue of powers vested in the office.

National ADR Day is observed every year on December 19.

The OADR is tasked to plan and implement appropriate activities for the observance of National ADR Day.

By promoting ADR through the establishment of National ADR Day, the proclamation supports the constitutional guarantee of speedy disposition of cases by encouraging faster, out-of-court resolution methods.
