Problematic lands are landholdings covered by CARP whose acquisition and/or distribution has been temporarily stalled due to legal, technical/operational, and/or administrative issues affecting program implementation.

The memorandum covers lands characterized as problematic in the PARC EXECOM-approved CARPER LAD balance database and lands initially workable but which later encountered problems during the Land Acquisition and Distribution (LAD) process.

The MARO conducts inventory, validation, and review of claim folders (CFs) and prepares case briefs within ten days upon receipt of the problematic lands list, forwarding these to the DAR Provincial Office (DARPO) for review.

The DARPO Operations Division must conduct inventory, validation, and review and prepare a case brief for each problematic landholding within ten days upon receipt of the list from the PDPC/PMEU.

The Provincial Task Force is composed of the Provincial Agrarian Reform Officer (PARO) as head, the CARPO for Operations, Quick Response Officer, a Chief of the Legal Division, and representatives of Civil Society Organizations if present.

The PARO shall issue an order directing concerned officials to proceed with the documentation of the landholding.

After proper investigation and in accordance with DAR Administrative Order No. 13 Series of 1990 and Memorandum Circular No. 8 Series of 2010, the landholding may be excluded from the CARPER LAD Balance database.

The RD monitors Task Forces, reviews pending cases for resolution, instructs CARPO to facilitate workable landholdings, may create Special Action Teams, and regularly reports to Undersecretaries for Field Operations and Legal Affairs.

The National Task Force includes Undersecretaries and Assistant Secretaries for Legal Affairs and Field Operations, Chiefs of staff, representatives from the Office of the Secretary, and Civil Society Organizations representatives. It reviews pending cases at the DAR Central Office and ensures prompt resolution through coordination with relevant bureaus.

Expenses of the Provincial Task Force are charged to the respective DAR Provincial Office, while expenses of the National Task Force are borne by the Office of the Secretary.

The PARO submits monthly reports to the Regional Director and the Assistant Secretary for Field Operations, while the PDPC/PMEU provides computer-generated monthly reports tagging problematic lands.

The Memorandum Circular takes effect immediately upon its issuance on August 16, 2011.
