Executive Order No. 482 is an executive issuance by the President, issued by virtue of powers vested by law. Its purpose is to create the National Single Window Task Force for Cargo Clearance to improve efficiency and effectiveness in cargo clearance through a single submission and processing of trade data for a single point of Customs decision, aligned with ASEAN Single Window (ASW) objectives.
The preamble cites: (1) ASEAN’s adoption of the ASEAN Single Window (ASW) core component at the 11th ASEAN Director-Generals of Customs meeting in July 2003 in Bangkok; (2) ASEAN leaders’ endorsement at the 9th Summit in Bali, Indonesia in September 2003; and (3) Inter-Agency Task Force meetings (Manila August 2004, April 2005, and another in 2005) that supported the concept and pilot implementation in the Philippines.
The NSW is a system enabling a single submission of data and information that are synchronously processed, resulting in a single point of decision for the release of cargoes by Customs, based on decisions made by other government departments and agencies communicated timely to Customs.
It aims to provide more efficient, effective, and transparent service to the public by enabling electronic processing through a single window, improving accuracy, timeliness, information exchange, reducing operational costs, and supporting better revenue collection.
Executive Order No. 482 creates (1) a Steering Committee and (2) a Technical Working Group. The Technical Working Group reports directly to the Steering Committee.
The Steering Committee is chaired by the Secretary of Finance. Members are: (a) Secretary of DTI; (b) Secretary of DA; (c) Secretary of DOTC; (d) Secretary of DILG; (e) Secretary of DOH; (f) Governor of BSP; and (g) Director-General of NEDA.
The Steering Committee sets policy guidelines for NSW and future ASW operations; crafts financial schemes/strategies to fund activities/projects from inception to operations to ensure sustainability; and ensures effective and efficient implementation of NSW and ASW thereafter. It is also tasked by the EO to promulgate implementing rules and regulations.
The Technical Working Group is presided over by the Commissioner of Customs. Its members are designated representatives from: CICT, BIR, Tariff Commission (TC), Philippine Ports Authority (PPA), BPI, Bureau of Quarantine (BQ), BFAD, BAI, Bureau of Import Services (BIS), LTO, Insurance Commission (IC), PEZA, and Mabuhay and Non-Mabuhay Lane (Department of Finance).
Examples include: (1) implementing Steering Committee policies/directives by coordinating establishment, implementation, operation, and monitoring of NSW/ASW; (2) identifying common definitions/data sets to standardize data and processes for integration; (3) delineating definitive roles and responsibilities of each participating agency; (4) creating a general conceptual framework and necessary IT instruments ensuring data integrity and security; and (5) complying with other Steering Committee instructions.
Customs Authorities are reaffirmed as the final and single decision-maker on cargo clearance and release. The NSW concept culminates in a single point of decision by Customs, based on timely communicated decisions from other government agencies.
The EO emphasizes standardizing data, information, and processes intended for integration through identification of a common definition/data set. This is a function of the Technical Working Group.
Because the NSW involves synchronized electronic processing and integration of multiple agencies’ data, the EO requires IT instruments and mechanisms ensuring data integrity and security. This is linked to the Technical Working Group’s function of creating necessary IT instruments/frameworks for integration.
Under Section 8, the Steering Committee shall promulgate and issue rules, regulations, and orders necessary to implement the purpose and provisions of the Executive Order.
Yes. Under Section 7, they may seek assistance of the ASEAN Secretariat to ensure a coordinated approach in implementing the ASW across ASEAN member-states.
All other executive orders, issuances, rules, regulations, or parts thereof inconsistent with Executive Order No. 482 are repealed or modified accordingly.
It takes effect immediately (Section 10). This means the creation and mandate of the Task Force can begin without delay for subsequent policy issuance, coordination, and technical work.
Steering Committee includes high-level policy and finance/coordination bodies (Secretary of Finance as chair; DTI, DA, DOTC, DILG, DOH, BSP, NEDA). Technical Working Group includes Customs leadership plus ICT/tax/customs-relevant and operational agencies (CICT, BIR, TC, PPA, BPI, quarantine/food/agriculture bureaus, import services, LTO, insurance, PEZA, and DoF lanes). The separation matters because strategic policy/funding decisions are handled at the Steering Committee level, while technical integration, data standards, IT frameworks, and inter-agency coordination are handled by the Technical Working Group.
