The Philippine Center on Transnational Crime (PCTC) is established to prevent and control transnational crimes in the Philippines, with a focus on drug trafficking, money laundering, terrorism, arms smuggling, trafficking in persons, and piracy, through strategic research, coordination with government agencies, and the establishment of a central database.

The PCTC was created through Executive Order No. 62, issued on January 15, 1999.

The PCTC is created under the Office of the President, and it is placed under the general supervision and control of the National Police Commission (NAPOLCOM).

The PCTC is headed by an Executive Director appointed by the President.

1) Directorate for Operations; 2) Directorate for Plans and Programs; 3) Directorate for Research; 4) Directorate for Technology Management; 5) Directorate for Administration and Finance; and 6) Other Directorates that may be created as the situation demands.

The EO covers: illicit trafficking of narcotic drugs and psychotropic substances; money laundering; terrorism; arms smuggling; trafficking in persons; piracy; and other crimes impacting the stability and security of the country.

It is meant to use modern information and telecommunications technology to create a shared central database among government agencies containing information on criminals, methodologies, arrests, and convictions relating to specified transnational crimes.

It must establish a central database on national and international legislation and jurisprudence on transnational crime, to recommend measures that strengthen responses and provide immediate intervention for prevention, detection, and apprehension.

It must establish a center for strategic research on the structure and dynamics of transnational organized crime, predict trends, analyze relationships of factors, and formulate strategies for prevention, detection, and apprehension.

The PCTC must design programs to enhance national capacity-building, support related ASEAN/international center programs, and explore/coordinate information exchanges and training with foreign governments and international organizations.

The EO authorizes the PCTC to select personnel from within NAPOLCOM, PNP, and other government agencies for detail with the PCTC.

It may enlist the assistance of any department, bureau, office, agency, or instrumentality of the government, including GOCCs, including use of their personnel, facilities, and resources, to carry out PCTC functions.

The EO grants the PCTC authority to take cognizance of the enumerated transnational crimes (drug trafficking, money laundering, terrorism, arms smuggling, trafficking in persons, piracy, and other stability/security-impacting crimes).

Agencies such as PNP, NBI, NACAHT, PAOCTF, PASTF, DILG, DOJ, DOF, DOTC, DDB, NPS, BI/BID, BIR, EIIB, BOC, NICA, AFP, LTO, NTC, NSCO (and others as needed) assist PCTC, showing it is an inter-agency mechanism requiring coordination.

The Executive Director reports to and is responsible to the President through the Secretary of the Interior and Local Government; the Executive Director has immediate supervision/control over PCTC units; and the Executive Director has direct operational and supervisory authority over personnel/resources detailed to the PCTC.

The PCTC must adopt, in coordination with other concerned agencies, necessary operating guidelines to implement the EO, subject to approval of the President.

The PCTC must submit reports of its activities with appropriate recommendations to the President.

It states that the PNP shall continue as the primary general law enforcement agency under RA 6975, and the PCTC will operate through close coordination and cooperation to ensure synergy in the anti-transnational crime campaign.

The EO enjoins vertical and lateral coordination among operating units consistent with security needs to prevent compromise in police operations.

It is provided an initial annual allocation of P100,000,000 for CY 1999, to be drawn from the President’s Contingency Fund and from government savings, subject to government accounting and auditing procedures.

It takes effect immediately upon issuance.
