It is pursuant to Section 68 of the Revised Administrative Code.
It is created in the Province of Davao, and the municipality is known as Sta. Maria.
The municipality consists of the barrios and sitios of Basiawan, Kidalan, Pongpong, Cogon, Kimatay, Pugad Buaya, Kadaatan, Sta. Maria, Culibao, Camasi, Kibulan, Kulungan, Longag Bato, Gandang, Sulok, Ogpao, Mamacao, Dool, Kisulad, Cabalantian, Tagbilaran, Boca, Dita, Malalag Tubig, Lagaylay, Tambo and Magapisa, all of the municipality of Malalag, Davao.
The seat of government is at the barrio of Basiawan.
It provides a technical boundary description: starting from where Malalag Bay cuts deepest inland and including specified areas, then following the ridge of the Baculing Mountain range crossing the Malalag-Malita provincial road near Km. 342/000 to the highest point above barrio Cadaatan, then a straight line toward Mt. Tangali to intersect the Malalag-Malita boundary line.
Malalag shall have its present territory minus the portions included in the territory of Sta. Maria.
The creation of the new municipality as proposed in House Bill No. 89 was approved by the House of Representatives.
It begins to exist upon the appointment and qualification of the Mayor, Vice-Mayor, and a majority of the councilors, and upon certification by the Secretary of Finance that the municipality is financially capable of statutory obligations and ordinary essential services, and that Malalag can still sustain its municipal government obligations after segregation.
Certification by the Secretary of Finance that Sta. Maria can provide for all statutory obligations and ordinary essential services of a regular municipality, and that Malalag can still maintain creditably its municipal government, meet statutory and contractual obligations, and provide essential municipal services.
The Mayor, Vice-Mayor, and a majority of the councilors.
Even if created by executive order, actual existence/operation as a municipality requires compliance with financial viability conditions confirmed by the Secretary of Finance, including the continued viability of the mother municipality.
