Questions (EXECUTIVE ORDER NO. 461)

Executive Order No. 461, December 29, 1961, created the municipality of Matalam in the province of Cotabato.

The municipality of Matalam was created pursuant to the provisions of section sixty-eight of the Revised Administrative Code and upon the recommendation of the Provincial Board of Cotabato.

The municipalities of Kidapawan, Kabacan, and Malang contributed barrios and sitios to form the municipality of Matalam.

The seat of government of Matalam is located at the barrio of Kilada.

The boundaries are described starting at the intersection of Malamote and Pandan Creeks, following various roads, rivers, and natural landmarks including Taculen-Malamote Road, Kabacan River, Pulangi River, Arakan River, Tuail Mountain Range, Tuail River, and specific points on the map, returning to the point of beginning at Malamote and Pandan Creeks.

The municipalities of Kidapawan, Kabacan, and Malang shall have their present territories minus the portions included in the territory of the municipality of Matalam as delimited in the executive order.

Matalam shall begin to exist upon the appointment and qualification of the mayor, vice-mayor, and majority of councilors, and certification by the Secretary of Finance regarding its financial capability to implement the Minimum Wage Law and provide statutory obligations and essential services.

The Secretary of Finance must certify that Matalam is financially capable of implementing the Minimum Wage Law, providing statutory obligations, ordinary essential services, and that the municipalities of Kidapawan, Kabacan, and Malang can still maintain their governments and obligations after segregation of the territory.

Matalam must be capable of implementing the provisions of the Minimum Wage Law, all statutory obligations, and ordinary essential municipal services.
