The barrio of Barobo.
It provides a technical description starting from the mouth of Pagbutuanan Cave at sitio Wacat and then traces straight lines and boundary courses along provincial and municipal boundaries, including the marine waters boundary, returning to the point of beginning.
The mouth of Pagbutuanan Cave at sitio Wacat, intersection points marked as Points aAa, aBa, aCa, aDa, provincial boundaries of Surigao del Sur and Agusan, and municipal boundaries of Lianga and Hinatuan.
Section 2321 of the Revised Administrative Code.
Lianga’s territory shall be its present territory minus the portions included in the municipality of Barobo, as delimited.
Upon the appointment and qualification of the mayor, vice-mayor, and a majority of the councilors, and upon certification by the Secretary of Finance that the municipality is financially capable and that Lianga can still maintain its municipal government and obligations.
The Secretary of Finance must certify that Barobo can implement the Minimum Wage Law and provide all statutory obligations and ordinary essential services of a regular municipality.
That after segregation, Lianga can still maintain creditably its municipal government, meet all statutory and contractual obligations, and provide essential municipal services.
It is a condition precedent for the municipality to begin to exist; without it, the executive order cannot fully operate to establish the municipal entity as contemplated.
It supports the validity and certainty of the municipality’s boundaries by referencing an official survey plan on file, with the indicated scale serving as part of the boundary determination.
It was signed by CARLOS P. GARCIA, President of the Philippines, and attested/issued by NATALIO P. CASTILLO, Executive Secretary.
It ensures that the new local government has the minimum leadership and representative body to function administratively and legislate/execute local governance duties immediately upon establishment.
Barrios and sitios are segregated from the mother municipality, organized into an independent municipality, and then legally brought into existence only after compliance with appointment/qualification and financial certification requirements.
