Q&A (EXECUTIVE ORDER NO. 195)

Executive Order No. 195 is an order creating the municipality of Malimono in the province of Surigao pursuant to Section 68 of the Revised Administrative Code.

The Provincial Board of Surigao recommended the creation of the municipality of Malimono.

It was created pursuant to Section 68 of the Revised Administrative Code.

The municipality of Malimono is bounded on the west by marine waters pursuant to Section 2321 of the Revised Administrative Code; on the north by the boundary between barrios Jugban and Malimono; on the east by the boundary between barrios Malimono and Sison and the Surigao-Mainit boundary; and on the south by the Surigao-Agusan provincial boundary.

The municipality contains the barrios of Malimono (the seat of government), Masgad, Cantapoy, and Pili, and the sitios of Cagtinai, Tinago, Cayawan, Hanagdong, Bunyasan, Dinaligan, Manhayag, Can-aga, and Karihatag.

It begins to exist upon the appointment and qualification of its mayor, vice-mayor, and majority of councilors, and upon certification by the Secretary of Finance that the municipality is financially capable of fulfilling its obligations.

The municipality must be capable of implementing the provisions of the Minimum Wage Law, providing for all statutory obligations and ordinary essential services of a regular municipality, and ensuring that the mother municipality of Surigao can still maintain governance after segregation.

The municipality of Surigao will retain its present territory minus the barrios and sitios that constitute Malimono, and it must still be able to maintain its government and obligations after this segregation.

It was signed by President Ramon Magsaysay and Executive Secretary Fortunato De Leon.
