Ferdinand E. Marcos establishes the Experimental Cinema of the Philippines to promote the film industry through production, financial assistance, and the creation of a censorship-free environment, while ensuring tax exemptions and support for local talents.

It is a corporation known as the Experimental Cinema of the Philippines, attached to the Ministry of Tourism.

It may produce or import all kinds of films for exhibition at the Film Center established under Executive Order No. 640-A.

The Cinema shall manage and operate the Film Center under arrangements it may enter into with the Cultural Center of the Philippines.

The Cinema must coordinate with the Filipino Motion Pictures Development Board in all matters affecting the film industry.

The Cinema may establish, operate, and maintain a special fund utilized to provide financial assistance to motion picture projects.

The Cinema may formulate and administer such a system, subject to the approval of the President, based on guidelines and rules promulgated by the Board of Trustees.

The Cinema may establish, operate, and maintain a Film Archive to preserve and disseminate all kinds of motion picture.

Examples include: (1) assisting Filipino talents in skill acquisition; (2) borrowing funds and acquiring property necessary to carry out its purposes; (3) investing funds and assets in undertakings it deems wise; (4) establishing and maintaining international film festivals and exhibitions; and (5) constructing and maintaining theaters, screening rooms, and similar facilities. (Also included: producing/importing films, managing Film Center, coordinating with the Board, establishing special fund, film rating system, Film Archive, and other functions authorized by law or the President.)

All films produced or imported by the Cinema for exhibition at the Film Center shall be free from censorship.

Three (3) members: (1) the Minister of Tourism or his duly authorized representative; (2) a Chairman; and (3) one member appointed by the President of the Philippines.

The Board must: (1) prepare and adopt necessary rules and regulations; (2) prepare and/or approve a budget; (3) review periodically administration and programs; and (4) perform other functions authorized by law.

The Director-General is the chief executive officer appointed by the President and is the Chairman of the Board; he/she submits policies, recommends and administers programs, directs and supervises operations, submits annual reports, organizes personnel, coordinates linkages, and performs other functions vested by the Board.

He assists the Director-General by implementing and administering Board-approved policies and by directing, supervising, and coordinating operations of Cinema departments and offices.

The Cinema shall appoint and maintain adequate technical and administrative staff in accordance with laws, rules, and regulations governing government corporations.

Donations/contributions/subsidies/financial aid to the Cinema are exempt from taxes of any kind and are allowable deductions in full from donors’ income for income tax purposes. The Cinema, its assets, acquisitions, income, and operations/transactions are exempt from all taxes, fees, charges, and similar impositions by government or political subdivisions, including import taxes, duties, and fees.

Three million pesos out of the Special Activities Fund for the initial operation; additional amounts needed for operations will be included in the General Appropriations Act.

After payment of liabilities, remaining assets are disposed of and turned over to a foundation or institution with similar pursuits, or to the Republic of the Philippines or its agencies/instrumentalities, as decided by the Board of Trustees.

All provisions of EO 640-A and other inconsistent laws/decrees/orders/regulations are repealed, amended, or modified accordingly—meaning EO 640-A’s provisions inconsistent with EO 770 no longer apply to that extent.
