A

Questions (Commonwealth Act No. 640)

Proclamation No. 1392 is issued pursuant to the President’s powers under Republic Act (RA) No. 7916, the Special Economic Zone Act of 1995, as amended.

It is designated as an Information Technology Center (an IT SEZ), to be known as “Circuit Corporate Center 2.”

Both the building and the parcel of land upon which it stands are covered and designated as the SEZ.

The building has a gross floor area of Forty-Six Thousand Eight Hundred Seventeen square meters (46,817 m²), more or less.

The area is Three Thousand Five Hundred Seventy-Two square meters (3,572 m²), more or less.

Along 3 Theater Drive, Circuit, Barangay Carmona, Makati City, National Capital Region.

The land area is covered by TCT No. 006-2017000040, and the subdivision plan is Psd-00-091383 (Lot 5-C of the subdivision plan).

The recommendation came from the Board of Directors of the Philippine Economic Zone Authority (PEZA).

The proclamation references PEZA Board of Directors Resolution No. 00-411 (s. 2000), as amended by Resolution No. 11-006 (s. 2011), 15-240 (s. 2015), and 17-472 (s. 2017), and Resolution No. 14-358 (s. 2014), as amended by Resolution No. 19-383 (s. 2019).

It also references RA 7916’s Implementing Rules and Regulations (IRR) and PEZA Board of Directors resolutions as amended.

It is meant to be both specific and approximate: it provides an exact technical description (points, bearings, distances, and plan references), while also stating the land contains an area of 3,572 m², more or less.

It begins at a point marked “1” on the plan, described by its relation to BLLM No. 1 in Makati City (e.g., N. 64 deg. 46' W., 1,727.02 m. from BLLM No. 1).

It is bounded on the NE along line 1-2 by Lot 5-E; on the SE and SW along lines 2-3-4-5 by Lot 5-F; and on the NW along line 5-1 by Lot 5-G (all based on subdivision plan Psd-00-091383).

The Subdivision Plan and technical description were prepared by Cristina M. Baldo, based on the survey conducted 04–07 January 2016, and approved on 03 May 2016 by Ignacio R. Almira, Jr., Chief—Surveys and Mapping Division, and Sofio B. Quintana, Assistant Regional Director for Technical Services, DENR-NCR.

It means the SEZ designation is not standalone; the rights, governance, benefits, and compliance obligations must follow RA 7916, its IRR, and applicable PEZA board issuances.

It is signed by President Rodrigo Roa Duterte, with an Executive Secretary signature (Salvador C. Medialdea) indicating the proclamation was issued by authority of the President and properly documented under presidential issuance rules.
