The legal basis is Republic Act No. 7916, otherwise known as the Special Economic Zone Act of 1995, as amended by Republic Act No. 8748, along with its Implementing Rules and Regulations and PEZA Resolutions.
The President of the Philippines has the authority to create and designate buildings as Information Technology Centers under RA 7916 as amended, upon the recommendation of the Philippine Economic Zone Authority (PEZA) Board of Directors.
The Negros First Cybercentre is located at Barangay 39, Bacolod City, Island of Negros Occidental, on a parcel of land Lot 112-A-2, Psd-064501-026934, with an area of 43,791 square meters, more or less, bounded by lots and roads as technically described in the proclamation.
The designation references Resolution No. 00-411 (s.2000), as amended by Resolution No. 11-066 (s.2011), and Resolution No. 11-523 (s.2011) of the PEZA Board of Directors.
Proclamation No. 802 formally creates and designates the building located in Barangay 39, Bacolod City, as an Information Technology Center known as the Negros First Cybercentre under RA 7916, as amended.
The Proclamation was signed by President Benigno S. Aquino III and attested by Executive Secretary Paquito N. Ochoa, Jr.
The proclamation provides bearings and distances specifying boundaries with adjacent lots and road lots, starting at a defined point and going through various points to enclose the 43,791 square meter area.
PEZA recommends buildings and areas for designation as Information Technology Centers and issues resolutions governing their operation, pursuant to RA 7916 and its amendments.
