Republic Act No. 9744 converts the Cebu State College of Science and Technology System (including its existing satellite campuses) into a state university known as the Cebu Technological University (CTU).
The main campus of the University shall be in Cebu City.
The Act includes the College of Fisheries in Moalboal; the Agro-industrial and Forestry College in Argao; the Polytechnic College in Tuburan; the College of Fisheries in Daanbantayan; the Fishery and Industrial College in San Francisco; the College of Industrial Technology in Danao; the College of Fisheries Technology in Carmen; the Abellana College of Arts and Trades in Mandaue; the College of Agriculture in Barili; and the Experimental Station in Sibonga (all located in the Province of Cebu).
CTU shall primarily provide advanced professional and technical instruction and advanced studies in specified fields (industrial trade, agriculture, fishery, forestry, aeronautics, arts and sciences, health sciences, information technology, and other relevant fields), and it shall also undertake research and extension services and provide leadership in its areas of specialization.
No. RA 9744 provides that no degree program shall be offered without the approval of the Commission on Higher Education (CHED) before the same is approved by the Board of Regents.
The existing high schools are transferred to the jurisdiction and supervision of the Department of Education (DepED), but they may remain and operate within the University campus until currently enrolled students complete high school.
CTU may operate a reasonably-sized laboratory school if it has a College of Education.
The administration of the University and the exercise of its corporate powers are vested exclusively in the Board of Regents and the President of the University.
The Board of Regents consists of: (1) Chairperson—CHED Chairperson; (2) Vice Chairperson—President of the University; (3) Senate Committee on Education chair; (4) House Committee on Higher and Technical Education chair; (5) Regional Director of NEDA; (6) Regional Director of DOST; (7) President of the federation of faculty associations; (8) President of the federation of student councils; (9) President of the federation of alumni associations; and (10) two prominent citizens from the private sector.
They are appointed by the Board from among at least five (5) qualified persons in the Province of Cebu recommended by a search committee constituted by the University President, in consultation with the CHED chairperson and other members of the Board.
They serve for a term of two (2) years from the date of appointment.
The Board shall regularly convene at least once every quarter. Special meetings may be called with three (3) days’ prior written notice, up to two (2) special meetings. Quorum consists of a majority of all members holding office at the time, but the Chairperson of the CHED or the President of the University must be present.
The University is headed by a President rendering full-time service, appointed by the Board on recommendation of a duly constituted search committee. The term is four (4) years and the President is eligible for reappointment for another term. The incumbent President of the Cebu State College of Science and Technology System, if qualified, shall serve as the first President of CTU. Within six (6) months before the incumbent’s term expires, the Board constitutes the Search Committee for the Presidency (SCP). If the Office becomes vacant, the Board designates an Officer-in-Charge within six (6) months pending appointment of a new President; the replacement serves only the unexpired portion of the term.
The Board may fix tuition fees and other school charges after due consultations. These fees and charges, including government subsidies and other income generated by the University, constitute special trust funds deposited in an authorized government depository bank; all interests accrue to the same funds. Income generated by tuition and other charges, and from auxiliary services and land grants, is retained by the University and may be disbursed for instruction, research, extension, or other programs/projects, with fiduciary fees disbursed for their specific purpose.
RA 9744 provides for an Administrative Council (President as Chairperson, Vice Presidents, deans, directors, and other officials of equal rank) for reviewing and recommending policies governing administration, management, and development planning; and an Academic Council (President as Chairperson, and all academic staff with rank at least assistant professor) for reviewing/recommending curricular offerings and rules of discipline, setting admission and graduation requirements (subject to Board review/approval), and formulating academic discipline policies (subject to Board approval).
RA 9744 states that political beliefs, gender preference, cultural/community affiliation, ethnic origin, and religious opinion/affiliation shall not be a matter of inquiry in faculty appointment. It also states no faculty member shall teach for or against any particular church or religious sect, subject to Board guidelines and qualifications.
All assets (real/personal), personnel, records, and liabilities/obligations of the former Cebu State College and its satellite campuses are transferred to the University; positions and security of tenure of faculty and personnel are respected. Parcels of land owned by the government occupied by the former campuses are declared property of the University and shall be titled under the University’s name. If the University ceases to exist or the lands are no longer needed, they revert to the concerned LGUs.
CHED shall conduct regular monitoring and evaluation to determine continuing compliance with requirements for university status. If CTU fails to maintain compliance, CHED shall recommend revocation of the university status to the Senate Committee on Education, Arts and Culture and the House Committee on Higher and Technical Education.
