It abolishes the PHSA (organized under Presidential Decree No. 1287) and creates in its place a regular government agency with the same name, hereinafter referred to as the High School.
To implement a general secondary-level program combined with a special arts-oriented curriculum aimed at the early recognition and development of highly talented students exceptionally gifted in the arts, providing a continuing source of excellent artists and leaders in preserving and promoting Filipino heritage in the arts.
Members include: (a) President of the Cultural Center of the Philippines (Chairman, ex-officio); (b) Undersecretary of DepEd, Culture and Sports (Vice-Chairman, ex-officio); (c) Artistic Director of the Cultural Center of the Philippines (ex-officio); (d) Director of the Bureau of Secondary Education (ex-officio); (e) Director of the PHSA/High School (ex-officio); and (f) representatives from music, dance, theatre arts, visual arts, and literature appointed by the Chairman upon recommendation of the Governing Board.
It must meet at least once a month; quorum is the majority of all members holding office at the time the meeting is called and present thereat.
It advises the Director on approval of appointments and contracts related to employment of teachers, lecturers, and other employees, including fixing compensations and conditions of employment, with concurrence by the Secretary of Budget and Management; it also covers removal for cause after due notice and hearing.
The criteria must include, among others, national competitive examinations.
It advises the Director on providing fellowships for faculty members and approving grants of scholarships, stipends, and other allowances to deserving students.
Upon recommendation of the Advisory Council, the Director may solicit, negotiate with, and receive from public or private domestic or foreign sources legacies, gifts, donations, grants, endowments, and contributions (and similar transfers of ownership/possession of real or personal property) for the benefit of the High School, subject to ratification by the Secretary of Education, Culture and Sports.
The Director must, upon recommendation of the Advisory Council and in accordance with pertinent accounting and auditing laws, rules, and regulations, prescribe measures necessary for proper use, maintenance, and safekeeping, and compliance with any terms and conditions attached to the donations or transfers.
The Director is appointed by the Secretary of Education, Culture and Sports upon the recommendation of the Advisory Council.
Career service personnel: finance, administrative and personnel staff and general education faculty; Non-career service personnel: visiting professors and arts instructors. Both are subject to civil service rules on wage and position classifications; both are entitled to retirement benefits enjoyed by government personnel, subject to existing laws, rules and regulations.
Services of incumbents whose appointments have not been processed through the Civil Service Commission are considered creditable for retirement or separation benefits as long as necessary requirements are met.
The High School is attached to the department, in consultation with the Cultural Center of the Philippines, for policy and program implementation with special emphasis on arts subjects, preparing students for careers in the arts.
All legacies, gifts, donations, grants, endowments, contributions, and similar transfers of real and personal properties received by the High School constitute the Arts High School Fund.
Signatories are the Director and the officer responsible for the High School finances. Regular reports on the status of the Fund must be submitted to the Advisory Council.
Within 120 days from approval of the Executive Order, the position structure and staffing pattern must be approved and prescribed by the Secretary of Education, Culture and Sports with concurrence of the Secretary of Budget and Management. Authorized positions must be filled with regular appointments by the High School or by the President (as the case may be). Incumbents whose positions are not included or not reappointed are deemed separated and entitled to benefits under existing laws.
Records, equipment, facilities, choses in action, rights, other assets, and personnel are transferred to the High School as necessary. Appropriations and funds revert to the General Fund. Remaining assets are disposed per the Government Auditing Code and relevant laws. Liabilities, if any, are paid under Civil Code rules on concurrence and preference of credits.
Presidential Decree No. 1287 (1978) is repealed, along with other inconsistent laws/issuances/rules. It takes effect upon approval, subject to publication in the Official Gazette.
