Q&A (DENR MEMORANDUM CIRCULAR NO. 10, S. 2004)

The purpose of DENR Memorandum Circular No. 10, Series of 2004 is to clarify that the cyanide criteria and standards referred to in DENR Administrative Order No. 34 and No. 35 should be understood as "free" cyanide.

It refers to DENR Administrative Order No. 34 (Revised Water Usage and Classification/Water Quality Criteria) and DENR Administrative Order No. 35 (Revised Effluent Standards of 1990).

"Free" cyanide refers to the form of cyanide that is not bound or complexed with other substances in water, which is the form to be used for compliance with water quality and effluent standards.

All industrial establishments, whether old, existing, new or proposed, and all users of the DENR Administrative Orders No. 34 and 35 are required to comply.

The Memorandum Circular took effect immediately upon its issuance on August 31, 2004.

It cites Section 69 of DAO No. 34 and Section 4 of DAO No. 35.

Section 69 provides the authority or basis for clarifying the standards on cyanide usage in water quality criteria as reiterated in the Memorandum Circular.

Industries must measure and report cyanide levels in the free cyanide form to comply with water quality and effluent standards, ensuring accurate environmental assessment.

The approval was recommended by Rolando L. Metin, Undersecretary for Management and Technical Services, and Julian D. Amador, EMB Director.
