Questions (DOTC REGIONAL MEMORANDUM CIRCULAR NO. 2005-001)

Its purpose is to cancel (and/or revoke) Certificates of Public Convenience (CPCs) of taxi units whose operators failed to avail of the LTFRB Regional Board’s decision by calibrating, testing, and sealing taxi meters within the prescribed deadlines, as a condition to implement fare increases.

To implement the consolidated decision increasing taxi fare rates (for taxis with the line Baguio City or La Trinidad to any point in the CAR). Compliance ensures meters are properly calibrated to reflect the approved fares.

The initial announced schedule was from December 8 to December 21, 2004.

It extended deadlines multiple times: to December 22–23 and 28–29, 2004, and again to January 3 to 8, 2005, to accommodate non-compliant operators.

Taxi meters must be calibrated, tested, and sealed from February 1 to February 8, 2005, upon payment of a fine of P2,500.00.

Their CPCs shall be deemed cancelled and/or revoked.

It requires both: the taxi meters must be calibrated and tested/sealed.

To submit an inventory listing of all existing taxi CPCs, and to compare the number of authorized taxi units versus the number calibrated. The difference determines how many taxi units will be opened for new CPC applications.

By computing the difference between the existing number of authorized taxi units (per inventory of CPCs) and the number of units whose meters were calibrated.

From April to December of the same year (2005).

They are banned from re-applying for a CPC for at least three (3) years, from 2005 to 2008.

The circular is signed by Alfredo P. Mondiguing, identified as Regional Director.

It takes effect immediately upon filing of three (3) copies with the UP Law Center pursuant to Presidential Memorandum Circular No. 11 dated October 9, 1992, and upon confirmation/approval of the circular by the LTFRB Central Office Board.

Students may examine whether the circular provides adequate notice, reasonable time to comply, and a fair procedure before CPC cancellation/revocation, given the drastic consequences.

The circular is issued to implement the consolidated decision increasing taxi fares for taxis with the line Baguio City/La Trinidad to any point in the CAR, by imposing meter calibration requirements as a condition to avail of the fare increase.

They indicate public and operator notice of the required calibration/testing/sealing schedule and conditions to avail of the fare increase.
