EO No. 120 created a Boxing and Wrestling Commission composed of a Commissioner as chairman and two members, all appointed by the President for such term and compensation as the President may determine and removable at his pleasure.
For administrative purposes, the Commission is placed under the executive supervision and control of the Department of the Interior.
A professional boxer/wrestler is one who competes for a money prize or purse, or teaches or pursues or assists in boxing/wrestling as a means of obtaining livelihood or pecuniary gain.
It can supervise and regulate contests/training exhibitions (including those with admission fees or purses), supervise officials and employees connected with the events, promulgate necessary rules (with approval), cooperate with amateur/collegiate boxing organizations, appoint personnel (with approvals), inspect books and records, and perform other duties later prescribed by law or executive order.
No. It is unlawful to stage such contests/exhibitions for a purse unless duly permitted by the Commission. Every permit specifies the event, opposing parties, venue, date, time, number of rounds, and other details the Commission may deem proper. It may be suspended or revoked for just cause.
Persons directly or indirectly involved, such as judges/referees, physicians, matchmakers, professional boxers/wrestlers, managers, trainers/seconds, timekeepers, announcers, and other similarly classified persons.
Licenses are obtained yearly. Each boxer/wrestler must be examined by a Commission-designated physician certifying physical and mental fitness before being granted a license and at least once a year thereafter; the Commission may order examination at any time.
No contestants under eighteen (18) years of age may participate in any professional boxing or wrestling contest or exhibition.
Except as otherwise provided, contests/exhibitions may be held not oftener than twice a week, from 2:00 in the afternoon until not later than 12:00 midnight.
Persons under sixteen (16), persons carrying firearms or deadly weapons (except government officials in official duty), intoxicated persons, and disorderly persons apt to disturb peace and order are not allowed to be admitted or remain in/around the premises. Minors under sixteen may be admitted if accompanied by parents or guardians.
The Commission assigns from among duly qualified and licensed persons: a referee/referees, judges, timekeeper, announcer, physician, and a Commission representative. With the exception of the Commission representative, salaries/compensation are paid by the promoter/entity conducting the contest/exhibition.
The promoter/entity must ensure peace and order in the premises and that the rules and regulations under EO No. 120 are properly observed.
Two bonds: (1) a surety bond equivalent to 25% of the total estimated receipts based on full seating capacity to guarantee, among others, that the main event is held (or rescheduled with Commission consent) and that reimbursement to ticket purchasers is made within fifteen days after default; (2) an additional bond equivalent to 25% to guarantee payment of services of boxers, wrestlers, officials, physician, timekeeper, announcer, and other persons entitled to payment as determined by the Commission.
The Commission/representative must be furnished with copies of contracts at least seven days before the event. If two or more promoters/entities file disputed claims on a boxer/wrestler’s services, the boxer/wrestler is automatically suspended until the claims are adjusted or legally adjudicated.
Purses are paid immediately after the contest/exhibition, or immediately after percentage determination by the Commission auditor for percentage contracts. Promoter/entity must pay in cash or check in the presence of an auditor, obtain receipts for payments made, and provide a copy of receipts to the Commission representative.
The Commission supervises ticket sales. Ticket sales are not authorized until plans showing seating arrangements, aisle and spacing, existing facilities, and the location of fire appliances have been approved by the Commission or its duly authorized representative. Tickets must show the price, promoter/entity name, and date (except complimentary tickets), and ticket price/date changes require Commission approval.
Promoters/entities must set aside 1% of daily gross admission receipts to defray general expenses of the Commission and personnel assigned to boxing/wrestling-related duties and other authorized expenses, which the Commission apportions with approval of the Secretary of the Interior among different promoters/entities.
Yes, amateur exhibitions held by and under the auspices of government-recognized schools/colleges/universities or generally recognized amateur athletic societies/federations are exempt if there is no purse to compete for.
For promoters/entities: license revoked and no further license thereafter. For participating contestants: first offense—suspended for one year; second offense—totally disqualified from further admission or participation in any such contests/exhibitions.
