Executive Order No. 888 authorizes Ministers and Heads of Ministries/Agencies in the Philippines to dispose of their unserviceable equipment and property, establishing a uniform and expedited procedure for disposal to prevent further deterioration.

It authorizes ministers and heads of government agencies to dispose of their respective unserviceable equipment and disposable property through a uniform and expeditious procedure.

The Ministers or Heads of Ministries/Agencies of the Government.

There was a considerable quantity of unserviceable government property deteriorating and exposed to elements, requiring a faster disposal process; the defunct Ministry of Public Highways had earlier authority to dispose similarly.

A Disposal Committee is created in each Ministry/Agency, composed of: (1) the Owning Ministry/Agency (Chairman), (2) Bureau of Supply Coordination (Member), and (3) Commission on Audit (Member).

It inspects (or authorizes inspection of) the field offices to verify the justification for disposal of unserviceable equipment and property.

It must consider obsolescence, market demand, physical condition, and results of previous biddings for similar property.

The committee recommends to the Minister/Head the manner of disposal considering pertinent provisions of the Revised Administrative Code and the National Auditing Code.

Sale through public bidding, with wide publicity and a minimum selling price set at realistic appraised levels considering market demand, physical condition, obsolescence, and relevant factors.

The committee may dispose the property in any manner most advantageous to the government, including barter or negotiated sale, but not less than the committee appraised value.

Barter with other government agencies and government-owned or controlled corporations.

Their representatives (including the COA Technical Staff assigned to the Disposal Committee) are “clothed with full authority to make final decisions in behalf of their respective offices” during committee deliberations.

Its recommendation is subject to the final approval of the concerned Minister.

They are committees created by the Minister concerned as needed in each region to conduct disposal activities (including public bidding) for unserviceable property in regional field offices.

The Regional Office of the Owning Ministry/Agency (Chairman), COA Regional Office (Member), and the Bureau of Supply Coordination (Member).

For unserviceable equipment: Inventory and Inspection Report (General Form No. 17-A) supported by individual equipment survey reports and current photographs (two views each). For waste materials and worn-out/obsolete spare parts: Waste Material Report (General Form No. 64-A).

It is subject to existing accounting and auditing regulations.

To handle technical and administrative matters of the committee, and manage safekeeping and systematic filing of committee documents and records, using existing personnel of the Ministry/Agency.
