The main purpose of Resolution No. 03-2018 is to approve the amendment to Section 22.4 of the 2016 Revised Implementing Rules and Regulations (IRR) of Republic Act No. 9184 and to issue a circular on the conduct of pre-bid conferences to minimize occasions of bidders’ disqualification due to non-compliance with bidding requirements.
The minutes of the pre-bid conference must be recorded and prepared not later than five (5) calendar days after the pre-bid conference.
The minutes of the pre-bid conference shall be posted in the website of the procuring entities for increased transparency in procurement.
Attendance at the pre-bid conference is not mandatory. It is open to prospective bidders and in the case of consulting services, to shortlisted bidders, but attendance is not compulsory.
For contracts with an Approved Budget for the Contract (ABC) of One Million Pesos (P1,000,000.00) or more, the BAC must convene at least one pre-bid conference. For contracts with an ABC of less than One Million Pesos, pre-bid conferences may be conducted at the discretion of the BAC.
The BAC must proactively discuss the requirements of the procurement project, initiate discussions on bidding requirements, explain common reasons for bidders' disqualification, entertain all questions from bidders regardless of purchase of bidding documents, and issue Supplemental/Bid Bulletins as necessary.
Prospective bidders must carefully examine the entire bidding documents before attending, raise all relevant questions or clarifications, send a representative directly involved in bid preparation to the conference, and secure all Supplemental/Bid Bulletins issued after the conference.
Section 63.1(b) of Republic Act No. 9184 and its 2016 Revised IRR authorize the GPPB to formulate, amend, and issue public procurement policies, rules, and regulations as necessary.
