The President approved the rules and regulations by virtue of powers vested in him by law, and pursuant to Section 6 of RA 7924, which requires that the Metro Manila Council adopt rules to implement the law.
The Metro Manila Council is the governing board and policy-making body of the MMDA and, under Section 6 of RA 7924, it adopted rules and regulations implementing the law.
It adopted the rules and regulations through Resolution No. 10 dated 9 May 1996.
It approves the Rules and Regulations Implementing RA 7924, which are attached as Annex "A" (the annex is said to be available at the Office of the National Administrative Register).
It states there is a need to formulate implementing rules to clarify the provisions of RA 7924 and harmonize them with other existing laws, rules, and regulations.
RA 7924 declares Metropolitan Manila as a special development and administrative region under the direct supervision of the President and creates the MMDA.
The memorandum order was adopted on 16 May 1996, and it references Metro Manila Council Resolution No. 10 dated 9 May 1996.
Section 6 is cited as the provision that authorizes/charges the Metro Manila Council to adopt implementing rules for RA 7924, which are then subject to approval by the President as reflected in the memorandum order.
