Section 6 of R.A. 9184 provides that the GPPB shall develop generic procurement manuals and standard bidding forms to systematize procurement, avoid confusion, and ensure transparency, with mandatory use by all government agencies.
The resolution states that the GPM was approved and adopted by the GPPB for use by all agencies effective January 2007.
The DOH was selected as one of nine (9) pilot agencies to undertake pilot-testing and customization of the Generic Procurement Manuals.
Mr. Orlando Cablayan, a World Bank consultant assigned to DOH, prepared and submitted DOH’s Customized Agency Manuals to the GPPB Technical Support Office on 14 November 2005.
DOH revised its CAM and submitted the same to the GPPB-TSO last June 2007.
The GPPB Inter-Agency Technical Working Group (IATWG) reviewed the final draft during its 10th regular meeting held on 17 October 2007.
It indicates that approval by the GPPB required incorporating specified updates and clarifications; the final approval (via the resolution) is thus conditioned on those recommended adjustments to ensure compliance with law and consistency in implementation.
Examples include: (1) incorporating the latest amendments to the IRR-A of R.A. 9184; (2) clarifying the role of the procurement service unit in the monitoring function of the Central Office Bids and Awards Committee (Section 2.1.2.6 of Volume 1); (3) clarifying whether the Essential Drugs Price Monitoring System captures ‘prevailing market price’ and, if so, adding a statement; (4) qualifying provisions prohibiting posting of surety bonds pending GPPB guidelines; (5) mandating supplier registration in Phil-GEPS; (6) clarifying the purpose of requiring proof of purchase/payment of service engineers/technicians.
The resolution states that the GPPB-TSO received the revised draft of the DOH CAM on 23 October 2007.
It resolves to approve the DOH Customized Agency Manuals for adoption and official use.
The resolution states it shall take effect immediately; practically, DOH may adopt and use the approved CAM immediately as its official procurement manual framework.
One of the IATWG revisions was to incorporate the latest amendments to the provisions of the IRR-A of R.A. 9184, ensuring the CAM aligns with updated implementing rules.
The resolution references Philippine Government Electronic Procurement System (Phil-GEPS). The IATWG recommended incorporating a provision mandating supplier registration in Phil-GEPS, to ensure participation and compliance with procurement system requirements.
Whether the Essential Drugs Price Monitoring Systems discussed in Section 2.2.3.3.1 of Volume 2 captures the ‘prevailing market price’; if it does, the manuals should incorporate a statement to that effect.
The IATWG recommended clarifying the role of the procurement service unit in the monitoring function of the Central Office Bids and Awards Committee in Section 2.1.2.6 of Volume 1.
It needed clarification in Section 4.5.4.1.1 of Volume 2 to explain the intent and relevance of such proof requirements to ensure proper interpretation and compliance within the procurement process.
