It modifies MC Nos. 2009-006 and 2010-004 by setting rules on when and how applications for extension of validity of expired Certificates of Public Convenience (CPCs) may be filed, including applicable penalties and limitations.

No. Except for CPCs covering Metro Manila Bus Operations, CPCs that expired within one (1) year after their expiration may be accepted, subject to specific penalty terms and conditions.
CPCs covering Metro Manila Bus Operations are excluded from the “expired within ONE (1) year” acceptance category.
A penalty fee of Ten Thousand Pesos (PhP10,000.00) per unit.
In addition to the PhP10,000.00/unit, the Circular imposes additional monthly penalties depending on the vehicle type: PUJs, Taxis, and School Transport Service: PhP1,000/unit/month; AUVs, Vans and Coasters: PhP1,500/unit/month; Trucks for Hire and Tourist Buses: PhP2,000/unit/month; PUBs (Provincial operation only): PhP2,000/unit/month.
They cannot file applications for sale and transfer and/or dropping and substitution of units within two (2) years from the date of issuance of the decision.
Exceptions: (1) dropping of phased out unit/s or compliance with DOTC modernization standards; (2) carnapped/stolen unit, with a Police Report or Certificate of Non-Recovery; (3) unit suffered an accident causing destructive loss (total wreck) and becomes unserviceable, with a Police Report and proof that the accident was previously reported to the Board as required.
It is the date when the applicant has fully paid the fees assessed by the Board and the Board has received the application/petition.
The decision must be rendered and/or released within the three (3) month provisional period. Upon grant/release of the decision, the provisional authority is automatically deemed revoked.
All issuances inconsistent herewith are superseded and amended accordingly; the Circular supersedes any and all issuances inconsistent with it.
It takes effect immediately following publication in a newspaper of general circulation.
