The creation becomes effective upon approval of the majority of votes cast in a plebiscite called for the purpose, conducted and supervised by COMELEC within 60 days from the effectivity of the Act, in the political units affected.

The expenses for the plebiscite shall be charged to the Province of Davao del Norte.

They continue to serve in the province they choose, and continue receiving the salaries they are receiving at approval of the Act until new salary readjustments under law.

Vacant elective positions in either province shall, for the time being, be filled by appointment of the President, and the appointees hold office until their successors are elected and qualified in the first local elections immediately following the approval of the Act.

Incumbent appointive officials and employees continue performing duties in the same province and continue receiving their salaries as of approval of the Act until new salary readjustments. Positions for Compostela Valley appointive officials must be opened and filled within 60 days from ratification, without prejudice to incumbents who may wish to serve in Compostela Valley.

The three incumbent representatives continue to represent the three existing legislative districts until their terms expire. The proposed districting takes effect in the next election for congressional representatives immediately following approval of the Act.

They are divided proportionately between the two provinces by the President of the Philippines upon recommendation of the Commission on Audit.

For the first year, the internal revenue allotment allocated to Davao del Norte is proportionately divided between Davao del Norte and Compostela Valley in accordance with a resolution submitted to DBM by the incumbent Sangguniang Panlalawigan of Davao del Norte, in consultation with the incumbent representatives.

It takes effect upon its approval, subject to the plebiscite effectiveness requirement stated in Section 5 for the actual creation of the province.

Although the Act takes effect upon approval (Section 11), the creation of the new province becomes effective only upon majority approval in the required plebiscite (within 60 days from effectivity of the Act) under Section 5.
