RA 8468 converts the Don Severino Agricultural College in Indang, Cavite into a State University known as the Cavite State University.
It must primarily provide advanced instruction and professional training (especially in agriculture, science and technology, education and related fields), undertake research and extension services, and provide progressive leadership in these areas.
It may offer undergraduate, graduate, and short-term technical courses within its specialization and capabilities, as determined by the Board of Regents.
The high school is transferred to the jurisdiction and supervision of the Department of Education, Culture and Sports, but may remain and operate within the University campus until students complete high school. The University may also operate a reasonably-sized laboratory school if it has a college of education.
Governance is vested exclusively in the Board of Regents. The Board includes: CHED Chairman (Chairman); University President (Vice-Chairman); Senate Committee on Education, Arts and Culture chair; House Committee on Education and Culture chair; NEDA Regional Director where main campus is located; presidents of faculty associations, student councils, and alumni association; and two prominent citizens from Cavite chosen from a list (recommended by a search committee with consultation involving CHED).
They serve for a term of two (2) years.
In multi-campus universities, representation is through the presidents of federations of faculty, alumni, and student councils.
The President is appointed by the Board upon the recommendation of a duly constituted search committee. The term is four (4) years, extendible only for another four (4) years (with special provisions on extension beyond retirement under Section 7).
The Board designates an officer-in-charge pending appointment of a new President.
The Board may fix tuition and other charges after due consultation. Such fees/charges, including government subsidies and other income, constitute special trust funds deposited in authorized government depositories; interest forms part of the same funds. Income may be retained and disbursed for University purposes, with fiduciary fees disbursed for their specific collection purpose.
Yes. Income from tuition and auxiliary services (and land grants, if applicable) shall be retained by the University and may be disbursed by the Board for instruction, research, extension, or other University programs. Fiduciary fees must be disbursed for the specific purpose collected.
Donations to the University are exempt from all taxes and are deductible for the donor’s income tax (subject to applicable rules). Purchases/transactions entered into by the University through the Board are exempt from all taxes and duties.
The Board must convene at least once every quarter. Special meetings require three (3) days prior written notice. Quorum is a majority of members holding office, but the CHED Chairman must be present; in his absence, a CHED Commissioner designated by him represents him with full rights and responsibilities. When CHED Chairman is absent, the University President (Vice-Chairman) presides.
No religious opinion or affiliation may be an inquiry in faculty appointments. However, no faculty member may teach for or against any particular church or religious sect.
All assets, fixed and movable, personnel, and records are transmitted to the University, including liabilities. Tenure and positions of personnel under existing laws are not impaired; incumbents remain under the same status until otherwise provided by the Board. Government parcels occupied by the College become University property to be titled under its name, and revert to Cavite if the University ceases or the parcels are no longer needed.
Heads of national government bureaus/offices may loan or transfer apparatus, equipment, supplies, and detail employees to the University upon request of the University President, provided it can be spared without serious detriment to public service. Detailed employees perform duties as required and the time counts as regular service.
Faculty members at the tertiary level are exempt from civil service examinations as a requisite for appointment, though the Board may still require other professional examinations to maintain academic standards.
