Republic Act No. 8612 converts the Central Luzon Polytechnic College in Cabanatuan City, Nueva Ecija, into a state university known as the Nueva Ecija University of Science and Technology (the “University”).
To primarily provide advanced instruction and professional training in arts, science and technology, education and related fields; undertake research and extension services; and provide progressive leadership in these areas.
Undergraduate, graduate, and short-term technical courses within its areas of specialization and according to its capabilities, as the Board of Regents may deem necessary.
It is transferred to the jurisdiction and supervision of the Department of Education, Culture and Sports, but it may remain operating within the University campus until its students complete high school; the University may also operate a reasonably-sized laboratory school if it has a college of education.
The Board of Regents; administration and exercise of corporate powers are vested exclusively in the Board of Regents.
Chairman (CHED Chairman); President of the University (vice chairman); chairmen of congressional committees on education and culture; Regional Director of NEDA where the main campus is located; Regional Director of DOST; President of the faculty association; President of the student council or student representative (with an election rule if absent); President of the alumni association; and two prominent citizens chosen from a list recommended by a search committee (appointed upon recommendation by the Board’s search committee).
If the student council president is absent or there is no student representative elected by the student council, the college must schedule one week for the campaign and election of a student representative.
Prominent citizens serve for two (2) years. Presidents of faculty and alumni associations and the student regent sit until the expiration of their term in those capacities. If vacancy occurs in the office of the president (of the University), the officer-in-charge designated by the Board serves only the unexpired term.
The Board convenes at least once every quarter; special meeting may be called with three days’ prior written notice. Quorum is majority of all members holding office, but the Chairman of CHED (or the President of the University as vice-chairman in his place) must be present. If CHED Chairman is absent, a CHED commissioner designated by him represents him with rights and responsibilities of a regular member; the President of the University presides in such meeting.
The Board may fix tuition fees and other necessary school charges after due consultations with involved sectors. Fees, government subsidies, and other income generated constitute special trust funds deposited in an authorized government depository bank; their interests form part of the same fund.
Fiduciary fees must be disbursed for the specific purpose for which they are collected.
Income from tuition fees and other charges, as well as from operation of auxiliary services and land grants, shall be retained by the University and may be disbursed by the Board for instruction, research, extension, or other University programs/projects (subject to the fiduciary-fee rule).
The President administers the University full-time, appointed by the Board of Regents upon recommendation of a search committee. The term is four (4) years and eligible for reappointment for another term; this does not adversely affect the term of the incumbent.
Administrative Council: reviews and recommends policies for administration, management, and development planning. Academic Council: reviews and recommends curricular offerings and rules of discipline; fixes admission and graduation requirements and requirements for degrees, subject to review/approval by the Board of Regents through the President.
Faculty members at the tertiary level are exempt from any civil service examination as a requisite for appointment, without prejudice to the Board’s right to impose other professional examination requirements to maintain high academic standards.
All assets (fixed and movable), records, and personnel, as well as liabilities/obligations, are transferred to the University; positions, rights and security of tenure of personnel employed prior to absorption are not impaired, and incumbents remain in the same status until otherwise provided by the Board. Government parcels of land occupied by the College become property of the University to be titled under its name.
The parcels revert to the Province of Nueva Ecija.
Submit a five-year development plan with corresponding program budget to CHED for recommendation to DBM; undergo a management audit in cooperation with CHED; set up organizational/administrative/academic structure including key officials; and establish at least four separate degree-granting units (including arts and sciences and one at graduate level).
No religious opinion or affiliation shall be the matter of inquiry in appointing faculty. However, no faculty member shall teach for or against any particular church or religious sect.
The University shall enjoy academic freedom (Sec. 16). No student shall be denied admission due to sex, religion, cultural/community affiliation, or ethnic origin (Sec. 15).
