Republic Act No. 9340 amends Republic Act No. 9164 to reset the dates of barangay and Sangguniang Kabataan elections and provides other related provisions for election synchronization and implementation.
The synchronized barangay and Sangguniang Kabataan elections are held on July 15, 2002, with subsequent elections on the last Monday of October 2007 and every three years thereafter.
For officials elected in 2002, the term starts on August 15, 2002. For those elected in the October 2007 election and subsequent elections, the term starts at noon on November 30 next following their election.
Incumbent officials shall remain in office unless removed or suspended for cause until their successors have been elected and qualified. Ex officio members of higher sanggunian as barangay or SK officials continue until the next barangay election.
The Liga ng mga Barangay conducts elections for ex officio positions in the sanggunians at municipal, city, and provincial levels within 30 days after the next barangay election under the supervision of the Department of the Interior and Local Government.
Funding comes from the Commission on Elections (COMELEC) appropriation under the General Appropriations Act, supplementary appropriations, COMELEC savings not exceeding P300 million, and an amount not exceeding 10% of the Sangguniang Kabataan funds reserved pursuant to Section 532(c) of RA No. 7160.
The Commission on Elections (COMELEC) shall promulgate necessary rules and regulations to implement RA No. 9340.
All inconsistent laws, decrees, executive orders, and rules or parts thereof are repealed or modified accordingly.
This Act takes effect fifteen (15) days after its complete publication in at least two national newspapers of general circulation.
If any section or provision of the Act is declared unconstitutional or invalid, the other sections or provisions remain unaffected and continue in full force and effect.
