To further strengthen the Philippine national population program by enhancing private sector participation, particularly through involvement in policy formulation and coordination with the Commission on Population.
PD 803 amends Presidential Decree No. 79 (as amended), specifically Section 6.
It vests POPCom functions in a Board composed of specified government/academic/executive members plus two private sector members with population expertise.
The Board includes: (1) Secretary of Education and Culture/Secretary of Health, (2) Secretary of Social Welfare, (3) Dean of the University of the Philippines Population Institute, (4) Director-General of the National Economic and Development Authority, (5) Executive Director of the Population Center Foundation, Inc., and (6) two other private sector members.
They must possess the necessary expertise in the field of population.
They must not be recipients of Population Commission program money.
Each is appointed by the President of the Philippines for a term of three (3) years.
It indicates that POPCom’s authority is centralized in the Board, which exercises both functions and powers, rather than being dispersed among individual offices.
The Executive Director of that Foundation is included as a permanent member of the Board of Commissioners.
To maximize the efforts and resources applied to the national population program.
Private sector participation must be strengthened, and private sector involvement in development and formulation of policy and plans is essential for effective coordination and execution of the national population program.
It repeals or modifies all laws, acts, decrees, executive orders, and rules and regulations (or parts thereof) that are inconsistent with PD 803.
It takes effect immediately upon issuance/effectivity as provided in Section 3; thus, the amended provisions apply right away without waiting for a future date.
It uses amendment by rewording an existing provision (amending Section 6 of PD 79 as amended) and includes a repealing clause and an immediate effectivity clause.
They are not qualified to be appointed as the two private sector members, since the law requires they are not recipients of such program money.
